Hi,

I am in the process of taking Barclays to court over £2k's worth of business acc charges, the case has gone from small claims to the local county court.

 

I have just recieved a letter from court saying the judge would like to see me in person for a prelim hearing.

 

Has anybody else come across this situation before?

 

Any help is appreciated.

Hi Jonnyboy,

 

Welcome to the site.

 

A preliminary hearing is generally a meeting between the judge, you and the Bank's lawyers to sort out things such as allocation and directions.

 

Did you use the business templates?

Hi Scoot,

Thanks for your reply, i didnt use the CAG templates but i did use the 'common law' phrase and not the 'consumer law' one for personal acc's.

 

In light of what you have said does it mean that i will have to square up to barclays lawyers during my hearing then, or is it just me and the judge? How prepared will i need to be?

 

Alot of questions, thanks for your help.

Did you refer to the UTCCR 1999 or UCTA 1977 in your particulars?

 

Barclay's lawyers are likely to be there.

 

Can you post the exact wording of the court order relating to the preliminary hearing?
