HI Guys,

 

I dont know if this is the right forum for my query but here goes, On the B&Q website yesterday I found some carpet on offer that was an unbelievable price, however you could only buy off line at certain shops, my closest being 15 miles away.

 

I decided to call the shop direct to see if i could pay for the carpet at my local store and have it delivered from the stated store. When I Spoke to the shop they advised the price was incorrect on the site and what they had in the shop was 16X more expensive than the website and so they advised i call their head office.

 

I spoke to head office who apoligised and said they would update the web to the correct price, well surprise surprise today I have been on the site and again the price is incorrect. Is there anything from a legal point i can do to enforce the rate on line and make B&Q offer the price they are advertising

The short answer is No. They are providing an 'invitation to treat' by displaying that price. You offer to buy - if they accept your offer then the contract is made at that price - they are quite within their rights to refuse your offer to buy.

 

There may be an offence under the Consumer Protection Act re misleading pricing but I'm very out of date with that side of things (It was S11 Trade Descriptions Act in my day!). Complain to your Local TS Department.

 

As they have been made aware of the error they would find it difficult to defend a prosecution if the incorrect price is still up.
