      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi All,

 

I'm so glad to have found this forum!! It's fantastic but there is so much to take in.

 

Halifax have charged me £ 39 yet again this week which is what prompted me to register and start claiming it back. It's so infuraiting!!! :grin:

 

I'm going to make a claim on 2 bank accounts and a credit card I have with Halifax.

I would consider seperate claims for all of them,

that way you can be sure the exact amount of charges are collected from the **** for each one,

be prepared for a long wait,

i had my cheque for the SAR cashed on the 21/3/07 and they have not even ordered them yet? they have approx 10 days before the next letter is going

I cant believe how easy that just was! I called 01383 743 354 (which i found on this site) got straight through to a lovely lady called Morag who will send out copies of all my statements free of charge.

 

Although she did say it's taking up to 2 weeks due to the amount of requests they are reciveing at the moment muahahahaha

 

So fingers crossed!

Just had a run in with Halifax myself. Accidently used my halifax to make a £50 debit withdrawal, no overdraft on it and only £35 in the account. So went £15 overdrawn. Got an email telling me I had done this so immediately went online to pay some money in only to discover they had already charged me £30 in charges. And to top it all because I went over this so called £39 buffer limit they charged me an additional £28, I have never been overdrawn before!! it was them that took me over the buffer limit. Paid £70 straight in but its no wonder banks get all the bad press. So £58 in charges for a accidental £15 overdraft.

 

Managed to shout at them enough and they refunded me £30 but they said if I had called them the day after I had the email I might have been able to get the £28 back as well. But because I dont read my email every day and so was 36 hours late in calling them I can't get it back.

 

So annoyed.

 

Anyway, thanks for letting me vent off some frustration and sorry for hijacking the thread.

Does anyone know if you can claim back cash advances charges on credit cards??

It's only £2.00 a time but hey, it all adds up.

My credit card statements arrived today. :-D They took less than a week to get here! I called them last Thursday and they were on my door mat today.

If anyone is trying to get their CC statements out of halifax I would really recomend ringing 01383 743 354. You get straight through to a person, there is no charge and they seem to be sending them out quite quickly so your money could be back with you sooner than you think :)

It's all quite on the front....But I'm itching for a response!

I posted an LBA for CC charges 06/05, delivered 10/05..they have 6 days to respond..

Posted a SAR for a current account 15/05 and delivered 16/05, statements due sometime before 26/06 Fingers crossed!

No wonder it was quiet! The idiots only went and posted the response to my LBA to my old address, the address on a closed account! Even after they have sent the response to my prelim to the correct address and I put my current address on every letter that I send them. Surely it cant be that hard to get right!!??? :x Luckily my mum still lives at my old address so I still got my letter but how many other people could they have done it to??? The morons!

Got another fob off letter dated 15/05, looks like i'm filling on Friday!

Got an offer letter woohoo! :D For the full £175 I was claiming on my CC. Only a small amount but feels like a huge victory!

The offer letter has come with 2 days to spare before I was due to file but 4 days after i recived a rejection letter to my old address??? Very strange...or maybe just plain stupid.

The account ive won on is closed so what do i have to do for them to pay me by cheque?
