Advice needed....:confused: :confused: :confused:

 

Got statements and sent of a letter asking for my money back.

 

Recieved a letter this morning explaining that my claim would be looked into and as there are thousands of applications mine could take a long time. The letter stated that someone would be in contact in 4 weeks to let me know how the investigation was progressing.

 

Do i wait the 4 weeks? Even though in the letter i stated 14 days for a FULL response or do i go to the next step?

 

Confused!!

Stick to the timescale of 14 days! This is your claim and you are in control, not the Halifax! 14 days is adequate time for a large corporation to respond. After the deadline issue your LBA and proceed from there. (We have all had that letter!!)

12-03-07 Halifax Received £1800

I got a similar letter yesterday and I've gone straight to stage 2 LBA... If its any help the first part of my letter states:

 

I write further to your letter dated 21st April 2007, which acknowledged receipt of my original letter dated 19th April 2007.

 

 

Whilst I am grateful for this speedy acknowledgement, I am disappointed that you have decided to respond with a standard letter, especially considering I had specifically asked you not to do so, in my original letter.

 

 

I would also like to take this opportunity to point out that my letter is not a complaint but a demand for repayment of charges which you have unlawfully taken. Under these circumstances I think it is neither fair nor reasonable for you to ask me to wait 8 weeks.

I don't think you even need to put anything like this but I preferred to explain why I wasn't prepared to accept their dealys.

Standard letter received from Halifax disagreeing with my argument against charges.

25/06/2007 Filed small claim for charges at Lambeth County Court - awaiting return of N1 form.

The template letters in the library are adequate for our purpose. As noodle says we're on OUR timescale now - NOT theirs!

One small point, when you give them 2 weeks make sure it's two weeks from receipt. If you don't use track and trace give them two days which is seen as 'reasonable' in court.

What you are doing is building a case ready for court. So always be careful of what you agree to, write etc in case it comes back and bites you!

As I said the letters in the library got me and others thousands!

The only letter you need to worry about is the one that says here is all your money! Until then stuff them!

ahhh, poor halifax,

we're a bit busy at the moment, because everyone wants the money back, that we've take unlawfully from them, and would you mind if we ignore your timescale and impose our own.

if they tried this with me i'd write back asking them how many times i'd asked them for more time, because i've no money, only to be told to sod off,

oh and heres another £30 charge because your skint,:mad: .

do you give them more time??? uummm NO

OK what exactly do you mean?? from the day i sent the letter or the date i assume they recieved the letter or from the day they replied to the letter?

My understanding is that now you have received a reply you go straight to stage 2 LBA letter. See the templates section for wording.

 

This letter gives them 14 days to accept your request. This should be taken from the date they receive it. If sent normal post you normally take that from 2 days after posting - seen as reasonable within a court setting. If you send it recorded then you obviously know the date they receive it.
