Mind racing last night/this morning ... will the cheque be for the full amount (as apparently they had to "revise" it, hence the delay in sending):confused: Has it really been sent by "special courier" to arrive by 10am today as I was told yesterday? If it doesn't arrive or is for a lesser amount, should we still go to court?

 

All will be revealed within the next few hours ...

well done jess and mimi - looking good for you - As Wragges dont seem to now their A from their elbow I am going to carry on quietly - no more nudge letters and hopefully it will slip through the net without a stay and I will get a judgement. Lets hope I get a lovely judge!

I'm delighted to announce that SIL received a cheque this morning for the FULL AMOUNT (plus few quid extra!) from A&L, amounting to just over £4k. This was delivered by DHL courier early this morning (they are pushing the boat outicon10.gif).

 

I'm absolutely delighted that, after nearly eight months, this has reached the conclusion we wanted!! She rang the court straight away and I've since typed her a letter to hand-deliver to them, asking them to keep her case open until the cheque clears.

 

She's rather shell-shocked at the moment ... the amount they've paid also includes MANY £5 monthly OD charges that "slipped in", so an excellent result all round:rolleyes:

 

Interestingly, the letter from A&L with the cheque stated "we have received from the court a claim that you have issued". I wonder if this means the court wrote to them ordering them to pay upicon10.gif

 

Hopefully this will help her a little in getting her life back together after the recent loss of her lovely husband to cancer. He was also my best friend and I promised him I'd continue with the claim for his wife and feel really chuffed that we've seen it through to the end.

 

To all those who've inadvertently included "unreclaimable charges", don't worry about it, the banks and solicitors are obviously just too busy to go over everything with a fine toothcomb.

 

Well, sitting here wondering if there's anything else I can claim for now. In many ways I shall miss all this:rolleyes: I'll be around on a regular basis though helping others and catching up with my friends on here, all of whom have been a TERRIFIC help and support. Many thanks also to "the Mods.", especially GaryH who has the patience of a saint:wink:

 

When the cheque's cleared, I'll be making a donation on behalf of SIL and submitting the litigation details.

Forgot to mention, Wasted Costs in hand and copy of info. already sent gone to the judge again, so will report back. Claimed for £500 with virtually all receipts, but consider we'll be lucky to get anything. Will report back in due course.

 

Hopefully, in view of the waste of the court's time, he'll oblige to some degree!

SIL received a letter from the court this morning confirming the case had been "struck out" in the claimant's favour, ordering A&L to pay up immediately and saying the court hearing had been "vacated". So, good 'old judge came up trumps in the end and ordered judgment by default, hence the desperation by A&L/Wragge to get the cheque delivered.

Such good news Mimi, you and SIL deserve every penny.

Just one point though, I know what hard work it has been getting the bundle together and I am sure you did much more than me... do you not feel a little peeved that it was never used in the end? and angry at Wragges for making you go through such time consuming work?

Not at all. If a "poor" bundle was produced, it might give Wragge the opportunity to find any loopholes and retaliate in response. If it looks well put-together and professional, they'd hopefully think ... "this person knows what they're doing", look through and realise they haven't a hope in hell of being able to do any sort of counter response to the court.

 

At least, that's what I'd like to think:rolleyes:

 

At the end of day, there's always the chance you'll have to fight your case in court, so you have to do the best court bundle you can .... for peace of mind and "just in case".

 

Wragge, at the end of the day, are just the middle men. I was always polite and courteous when speaking to them (though it was hard work at times:rolleyes:). They're acting on behalf of their client and being told what to do ... no point in losing your "rag" (sorry:rolleyes:) with them.

congrats MJ - we have heard nothing from Wragge / A&L - they never did send us a copy of their bundle - nor did the court reply to the Judgement request that I sent & I have now had a 'stay' letter from the court so we are totally stuck as it was staayed at the courts own initiative.

Oh well, only another couple of years to wait then!

Have you tried ringing the court to query it? If you put your judgement in a while ago, it seems very unjust if you don't get your money without having to wait. Just my thoughts ...

yes, we put in the order for judgement on abouth the 29/30th June - so heard nothing for over a month (got a cover letter from wragge saying that they had enclosed a copy of their letter to the court - which they hadn't!!)

then today got the notice of stay from the court - joy.

might give them a call & see what they say!
