I have made a request under the F.O.I (freedom of information act)for the following to the BBC;

 

“1. All footage related to the BBC Whistle Blower programme on Bank charges.

2. Any correspondence relating to the production of the programme.”

 

 

Can any one help with there response? Can this info be obtained under the provisions of the Public Disclosure Act? And use the F.O.I Combined?

 

 

 

There response

 

Your request falls outside the scope of the Act because the BBC and the other public service broadcasters are covered by the Act only in respect of information held for purposes “other than those of journalism, art or literature” (see Schedule I, Part VI of the Act).

 

We are not therefore obliged to supply information held for the purposes of creating the BBC’s output or information that supports and is closely associated with these creative activities.

 

Information which is not subject to disclosure under the Act because of Schedule I might otherwise be exempt from disclosure because of the application of other provisions of the Act.

The Freedom of Information Act is aimed at information held by Government agencies and departments... information generally which relates to Government business and serving the public good. Nothing the BBC holds in relation to that program falls into these categories - they are a public service broadcasting organisation who investigated something off their own bat - nothing whatsoever to do with Government.

 

Did you try writing to them and just ASKING?! Even when you're trying to get information out of central Government you would write and ask first and if they refused THEN hit them with a FOI request...

By the way - the BBC are EXTREMELY unlikely to furnish you with information related to the creation of the program as this information probably contains the personal information of several individuals who wish to remain anonymous; they would therefore be committing an Offence under the Data Protection Act by sending you this information, and also breaching a duty of trust which they hold to their sources.

To protect individuals all they have to do is black out there name.

 

And still, you will fail. They will claim that it is their proprietary internal information of a sensitive and commercial nature. I can't see them releasing this stuff to anything short of a Parliamentary Select Committee - where it may already have been sent BTW. If it gets to a PSC it will THEN become Public Information disclosable under the FOIA.

Not agreeing or disagreeing with anything posted above, but if the BBC are funded by the government why shouldn't they be covered by the FOI?
