    • Of course don't pay.  They haven't bothered to do anything to establish keeper liability and as you said the car park is rubbish anyway with no marked bays.  Plus, what is "incorrectly parked" supposed to mean?  Anything and nothing.   Thanks for already filling in the forum sticky.  You left the PCN completely unredacted but I've sorted that out.   I don't think the IAS are the appeals body, it's BPA/POPLA which the fleecers have described as "independent appeals service" (the illiterate idiots have used capitals for some reason).  Not that it matters as you won't be wasting time appealing.   From the photos presumably your car was photographed by some creep walking around any spying on cars.  Did you get a windscreen ticket?

    • Hi, quick update on this case   Mediation was set for today and I never received a call, I called the mediation customer service and it turns out Hermes had cancelled it on 15/09 and I will receive a letter to inform me - too late   The case has now been transferred to the local court and the mediation service told me to wait until i hear from the local court as they may schedule a mediation, because it can't be rescheduled through small claims. I received an email from a Hermes lawyer on 15/09, the same date they cancelled    Getting a bit more complicated than I anticipated but hopefully will be sorted when the local court get in touch. I haven't replied to the email as I have sent all this information before and dealing directly with Hermes doesn't seem wise at this stage. I didn't expect them to dodge mediation though so not sure what to expect next. If you have any experience with this, please let me know. Thanks

    • Hi all,   Looking for your advise.   Took a short holiday to Cornwall last week and whilst there visited St Michael's Mount.   Parked in the car park paid for my ticket but a few days after I received a PCN charge of £100.00 for parking on the line of the parking bay.   When I arrived at St Michael's Mount it was wet and windy, the car park is gravel tracked and therefore I didn't actually notice there were parking bays marked.   Want to know if I should ignore, appeal or reluctantly pay. Hi!

 

I am new to all this but have already tried (a few weeks ago) to ask Smile to send me my last 6 years' statements, and they replied saying that the total cost for the statements would be £590!! This is made up of the past 12 months statements costing £2.50, and any statements over 12 months costing £10 each.

 

Smile do advise that you print off your monthly statements, but as I have no access to a printer I have never done this.

 

Is there anything I can do about this, or am I bound by the fact that they state the statement charges in their terms and conditions?

 

Sorry if this is a previously asked question but I can't seem to find a thread about it so would be really grateful for any advice.

If you have already done this when you initially asked for statements remind them of this and that they are legally only allowed to charge a max of £10 and the 40 days are ticking. Oh almost forgot......make sure everything you send them is by recorded delivery. Then they can't deny they got it.

That's really helpful thanks... I hadn't sent a SAR at first, I just sent them an e-mail asking for the statements. I'll get the letter sent off to them asap and keep my fingers crossed!

I do not have a printer either, but use a nice (free!) programme called CutePDF which means you can print anything and it saves it as a PDF document. I have a folder which I keep all my PDF Smile statements in for future reference.
