Help - C/Card Costs can you claim even under debt management scheme??

Hi All

A question if you don't mind. Firstly some background - I am currently progressing claim against Nat West for my bank charges over the last 6 years. And am thinking of doing the same with regards to the credit cards I used to have.

The bit i am not sure of is about a year ago now I went into a "debt management" scheme with Eurodebt. basically I pay an amount to Eurodebt each month and they pay tiny amounts off the credit cards and loans etc...

 

If I was to claim back the charges from these cards would this put the whole debt management scheme in jepordy?? And should I approach Eurodebt with this suggestion first.

 

The way I am thinking is that it wouldn't suprise me if the charges where quite high a few of these accounts and they basically could write it off against the debt still owed to them (or even better write off the debt in leu of paying back the charges.

 

Please help if anyone has any suggerstions as to what to do or what the outcomes could be

My opinion is that the two things need not be related. The card company acted unlawfully in applying charges to you account and you should recalim them. Eurodebt do not need to be involved.

 

When it comes to the credit card company paying you back (which they will), you can insist they pay you by cheque so you can choose whether to use the money to pay off Eurodebt or not.

I think you will have inform Eurodebt if you recieve settlement, as under your agreement you will have to disclose any 'windfalls'.

Natwest can demand that the refund you receive pays off the money you owe them.

Also if you manage to get a cheque from Natwest they will be expecting a better monthly payment through your Debt management program, and if they don't recieve one they may pull out of the agreement, as they will have proof that you have got more money.

 

I have a DMP with Payplan, and as far as i am concerned if they use the refunds to pay off what i owe them thats fine by me,

If youre in a DMP you have to include all your creditors or it wont work. They allocate a precentage of our funds to each comapny based on the amount you owe

 

YOu have to share your available income between all your creditors.

No the credit cards are not with nat west (Cap 1, Mint, MSDW, & Egg also Debs store card)

 

Like I said I was hoping that I could put the claims in for whatever charges I have had over last 6 years and basically the credit card companies can keep it and wipe out the balances for all i care (would rather get rid of the debts)

 

What i was really worried about is if I start the process will the credit card companies start playing silly buggers over the payment plans that have been set up.

 

And thats why I was thinking should I speak to eurodebt first.

I am in the same position - I have a DMP with CCCS - I spoke to them about it and the above is correct.

 

If you are successful then the funds would have to be repaid to the o/s debt!

 

It should not have a negative effect on your DMP. Best thing to do would be to speak to Eurodebt.

Hi Drew -- just a quick question, do Eurodebt charge you for their services??

 

If they charge a monthly fee, then you must consider changing to one of the free providers of the same service, ie Payplan or CCCS.

Halifax - £2281, successfully refunded all charges after LBA letter & telephone call.

Have been offered the difference between the £20 and £12 charges from Capital One -- am sending LBA for remainder.

GE Money - Received settlement of £441, being total charges requested. No interest though.

CCA'd Bank of Scotland / Blair Oliver Scott to produce CCA Agreements on two Credit Cards - well in default, although still chasing payment!!!

EOS Solutions "ceased action on account" on behalf of a friend.

 

All in all, quite busy at the moment and enjoying every minute of it

Yes they do - It was around £1500 split over 6 months but overall it has prob been woth it to get everyone off my back - That was for debts of around £22,000.

I understand how difficult it is with everyone and I resisted going into the DMO - I tried to organise my payments myselft through National Debtline -but since handing it all over to CCCS its been much easier!

 

Can you change over - if you can it would be worth it, and you can check progress of your DMP online! Its a good feeling to see your debts being reduced each month! I find CCCS very helpful.
