Hi everyone, after sending of my LBA to Lloyds 18 days ago I have now filled in my N1 form and i am going to post it today, I just want to make 100% sure that i have done it correctly, I have filled in all the relevant details and attached a schedule of charges with the interst, using the template on this site. Do I now just send it to the court now with the £120 fee??? I send a copy to Lloyds and keep a copy for myself. Where will I find the address for the court, I have magistrates court and County court, is the small claims court different altogether???

As far as I know you send all the copies to Court and they will send a copy to Lloyds for you.

well i have been on to the court today and let them know that i have only sent them 2 copies instead of 3. they have said its okay that they will just not send a copy back to me, which is fine as i have a copy anyway. They have cashed my £120 cheque and told me i will receive my letter within the next few days. is it from the date Lloyds recieve letter from court that they have 28 days to reply?

Hi

Lloyds have 14 days from the date the claim was served (it is served 5 days after you filed it) to acknowledge the claim, and then 28 days from the date it was served to enter a defence. You will then receive a copy of their defence and you may get an Allocation Questionnaire to fill in. These links will help you with that if you get an AQ:

Pleas can someone please help me with this, i rang the court today to see how to amend my claim, didnt put my account number on!!!!!! (how stupid) the court is closed today due to industrial action. when i ring them tomorrow will they allow me to go down and amend it or will i have to write in and if the latter what will i have to say. when I rang them on Friday they said they would be dealing with cases brought in that day this week. so does that give me a bit of scope before they send it off. If I am too late will they throw it out of court and will I have to send in another £120 (which i struggled to find the first time!!) I am so angry with myself, i feel i am losing the plot now and i was so upbeat to start with

thanks Michael and no i didnt put it on the schedule either!!! I cannot believe how stupid I have been, its just common sense but i got so carried away making sure i had got all the claim written right i forgot the basic things! So anyone new please learn from this silly mistake:mad:

Hi everyone, good news the lady at the court has put in my sort code and account number onto the N1 form and also onto the schedule of charges. Phew!

 

Now the embarrasing bit, I am currently just got the tip of my head above the water with my debts but am sinking rapidly, this money will not only bail me out but will put me back in the black. I feel sick with worry of paying everything. could anyone tell me how long it would be before i get my charges back, I know you cant give me an exact date but the lady is serving the claim to Lloyds today so i am thinking i may get them back mid June to end of June do you think that is a reasonable assumption. Sorry if i sound bad, but it will take such an enormous amount of pressure off me it will be untrue. I get married mid July and just want everything sorted for then.

It really is impossible to say......

Claims seem to take different routes.

 

You may recieve a settlement offer.....but that could come anytime upto the day of the Court hearing, if it gets that far.

 

And even once an offer of settlement has been made, it would appear people are STILL having to wait for the money to reach their accounts, sometimes upto 3 weeks, after accepting the offer.

 

Sorry i cannot be more positive

:( just saying it how it is.

 

One thing is for sure though .... You will get the money back eventually

Whit Whoo just got in from work and a letter waiting from the bad boys offering me £750 in full and final settlement, it says it will go into my account in the next 10 days, letter dated 30th April. I have just checked my account but its not in yet:-(

 

Do i just write to them now and say i will accept the £750 as part settlement but will carry on with the rest of the claim or do i just ignore it and carry on as my N1 form has already been sent
