I have a court date of 11th May for a claim of £1926.84 + court charges and i am just putting together the court bundle to send off tomorrow. I seem to have mislaid one of the letters Barclays sent to me. It was in response to my first letter and it was a holding letter saying they would respond in 14 days. Will this have a big impact on the claim? Am i going to look like i don't know what i'm doing? Do you think i should put a note with the bundle explaining about the letter (it is referred to in the next letter from Barclays)?

Bec, Dont worry about the letter,

Send your bundles in before 25th though to be inside your deadline.

I would send Barclays by Special Delivery, and hand the other to the court. [get a receipt]

I advise you, on 27th of this month contact the Litigation Team and ask to speak to who ever is dealing with your claim.

Thanks for that dar3n! I've put the bundles together all ready to go tomorrow. What is the best address to send them to? Is it the freepost one or the litigation team?

I've sent the bundles off and have checked online that Barclays have recieved it so i'm going to give them a ring tomorrow and see if we can come to an arrangement. I'm very nervous though!!!!!!!

This is understandable, but really there is no need, thr Litigation team are a real nice bunch, very polite.

Theyre not their to talk down to you or try to make it look like its your fault, their job is to settle the dispute as quickly as possible.

They will check your figures out and give you a settlement amount.

If this does not match yours then disagree.

Before you contact them, update your SOC's and make sure you have added the court costs on.

 

When you both agree to the amount, they will send a letter for you to sign and return.

You are quite in your rights to amend anything you dont agree with.

One thing we do suggest is you cross through the 'confidentiality' sentance and initial it.

Also at the bottom before your signature add in the following sentance

- The court will be instructed to stop the proceedings of this claim only when I have received cleared funds to the full amount as agreed -[and initial]

Woohooo!!!!!

 

Just to give you all an update - I rang the litigation team last Friday and was ensured that they would settle in full. I got the letter yesterday and I'm just about to fax it off and I should have the money in my acount either later today or tomorrow! :) :) :)

 

It has been a long, and sometimes, scary journey but I'm SO glad I stuck to it and didn't just give up or take the first settlement offer of £850. I'm having a baby in october so this money is going to come in so handy. I can buy a car now. I will, of course, be making a donation to this site. Without this I would've jacked it all in months ago.
