Hello all

Sent my first letter off requesting charges plus interest totalling £3101.46.

Got a reply saying saying Financial Services Authority gives Halifax 8 weeks to investigate and respond. They have also written "If, for any reason, we are unable to respond fully to your concerns within the next 4 weeks we will write to update you of our progress."

 

Talk about stalling.

 

Should I go ahead and send the letter in money saving expert's step 4, threatening to take it to court ????

After you send the prelim letter you wait 14 days and then send letter before action. Stick to your timescales and not theirs. What interest are you claiming?

Hi there

 

I recieved this reply exactly 14 days after my first letter. Do I have to just sit and wait for 8 weeks for them to just probably say 'we have looked into it and we are not refunding'..... Or should I send letter 4 saying I will take you to court if you don't give me an answer in 2 weeks.

I'm claimimg 8% interest.

 

Ps. Also got more charges! in the past 2 weeks which I want to add onto the claim and thought this would be a good point in which to do this.

No don't wait 8 weeks. Send your letter before action giving them a further 14 days to comply. Send another spreadsheet of your charges with the new ones added on. You can keep on adding to your claim right up until you file with the courts.

Rach your not making a complaint your asking for a specific amount of money to be returned to you, so they can forget about 8 weeks. Stick to your timescale not theirs. This is purely a stalling tactic by the bank so send them letter 4 your LBA at which point you'll probably get the "we are considering your claim" letter.

I would include in your LBA the new charges and obviously add it to your court claim if necessary. You will need to word your court claim so that the balance is floating I think (so that you can add charges if there are more before the court date). I'm not quite sure how to do this but I would have a look through the N1 templates, etc. I'm sure someone will be able to give you better info on filling in the N1 if you have to end up filling at court.

Do you mean replies from halifax? The address at top of this response is PO Box 548 Leeds which is different to the one I sent my first letter to.

Should I reply to this address or original address of Trinity Rd Halifax ??????

 

Or if you mean templates I'm using. Then it's the ones off moneysaving expert site.

Send your LBA to Leeds. Once you have sent it, read up on the filing a claim with the courts. Go to the bank templates library and it will give you a choice of filing an N1, as rory32 said, or you can file on line with MCOL.
