      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi folks, here's the story so far....

 

Claiming £1606 in charges, (£2100 inc interest)

 

10 March - prelim letter - got std fob off letter

 

29 March - LBA - got std fob off letter

 

15 April - MCOL claim filed - got std fob off letter!!

 

17 April - Claim acknowledged with intent to defend - Surprise surprise!!

 

21 April - Sending schedule of charges to the court

 

Will let you know whats happening as it goes on, wish me luck

I submitted my claim via MCOL recently and I've now had the acknowledgement and intent to defend response from Nationwide. At the weekend i went to send off the schedule of charges to the court and noticed an error on the spreadsheet - a date was 2001 instead of 2002 which meant that the interest charged was too high by £0.45.:-x

 

I sent the schedule off to the court with a covering note explaining the difference in the total amount but what happens now?

 

Has anybody else cocked up like this?

hi xj, as you have already sent a letter to the court i think this should be ok, if you are still in doubt why dont you give the court a call they are very helpful, and should be able to help you out.x

YEEEEHAH!!!! got home today and checked my bank account - 3 deposits showing......:-D :-D :-D

 

They've paid up in full, 28 days wasn't up till 21st May either.....

 

Awesome - I'm off to the pub now!!!

Well done, XJR. my 28 days is up on 8june. They`ve acknowledge claim so now i`m just praying cus mines for 13.5grand. Only just found this site so hopefully i`ll keep u all posted.

Hi there,

 

Just sent my initial claim letter of for £1900 and got a very polite letter back basically saying No. ( I presume this is the usual that everybody is talking about it?) But they suggest if I am not happy to contact the Financial Ombudsman. I dont know whether to try this route or carry on with the letters? Has anybody else tried the financial Ombudsman?

Well done XJR. I'm just in the early stages of the process of getting my money back from Nationwide, I'm going to send my second letter tomorrow. I'm so glad other people have had their money back. It really gives me a sense that this is the right thing to be doing. I'll let you all know how I get on.

Just follow the procedures from the site and it should all be fine - just check and double check everything before sending stuff off or during the MCOL process, i screwed up on my spreadsheet (see post above) but got away with it! There's been a few posts about using the FO instead - put a post up and ask the question, everybody's really helpful around here.

 

Start deciding what you're gonna spend the dosh on, unfortunately my otherhalf has spent mine for me!!:-? :-?

i have filed for 5.5k been turned down twice now and have filed in court.N/W have said they are going to defend all of claim:(

When you say you've been turned down twice do you mean you got 2 std fob off letters? If so then thats just standard operating procedure for NW.

They did exactly the same to me. Including the intent to defend etc. Towards the end of the 28 days period they'll enter a defence stating that they've refunded you the amount claimed, keep checking your bank account from around 21 days into the 28 to see if there's a surprise waiting for you.

Just keep following the process and all should be good.

 

If you have any other questions start a thread in the forum and folks will chip in and help like they did for me.

Ihave to admit i was panicking too, thought of going to court wasn't fun. I hadn't done any preparation when they paid out, i was going to do it the next week when the 28 days was up.

 

Because of the delays involved in a case actually going to court you'll have some time after the end of the 28 days to prepare. There's plenty of people on here with some legal expereince and specifically of these type of cases to help if it goes that far. However, as far as i know NW haven't gone to court yet.

Can you tell me which address did you use for your 'Letter before Action'?

I have had my first refusal but dont know where to send this letter.

 

Still really confused about interest too. My initial list of claims which just purely for the charges and no interest what so ever. Do you think this is ok?

Hi Nationwide fans, trying to get to grips with the fact you're all doing so well.

Just sent (next day recorded delivery) a claim for a poor friend, for £1522, only poor cos the bank keep charging her so much. I am looking into the court procedures now. We'd be grateful for any useful tips!
