    • it is NOT A FINE.....this is an extremely important point to understand no-one bar a magistrate in a magistrates criminal court can ever fine anyone for anything. Private Parking Tickets (speculative invoices) are NOT a criminal matter, merely a speculative contractual Civil matter hence they can only try a speculative monetary claim via the civil county court system (which is no more a legal powers matter than what any member of Joe Public can do). Until/unless they do raise a county court claim a CCJ and win, there are not ANY enforcement powers they can undertake other than using a DCA, whom are legally powerless and are not BAILIFFS. Penalty Charge Notices issued by local authorities etc were decriminalised years ago - meaning they no longer can progress a claim to the magistrates court to enforce, but go directly to legal enforcement via a real BAILIFF themselves. 10'000 of people waste £m's paying private parking companies because they think they are FINES...and the media do not help either. the more people read the above the less income this shark industry get. where your post said fine it now says charge .............. please fill out the Q&A ASAP. dx  
    • Well done on reading the other threads. If ECP haven't got the guts to do court then there is no reason to pay them. From other threads there is a 35-minute free stay after which you need to pay, with the signs hidden where no-one will read them.  Which probably explains why ECP threaten this & threaten that, but in the end daren't do court. As for your employer - well you can out yourself as the driver to ECP so the hamster bedding will arrive at yours.  Get your employer to do that using the e-mail address under Appeals and Transfer Of Liability.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

No, they coughed up (ie settled out of court) last time.

 

Yep, I was reading up yesterday & it says that when you fill in the warrant of execution form, it's actually recommended that the address you nominate is an address at which they carry on business (ie a branch address) rather than the registered address, in case they don't have goods there that can be taken by the bailiffs.

 

I am looking forward to this one though. I'd like to see them appeal, their grounds won't exactly be very strong since they couldn't even be bothered to reply to my claim...

July 2007: Claim 2 for £307 WON! after quiet word from the bailiff!!

It is possible, yes. If you are really concerned, the best bet is to open a parachute account (ie another one with somebody else) - halifax are even given you £100 free when you open with them! You do need to be aware that Abbey could withdraw your overdraft etc, although to demand £1600 immediately would be somewhat unreasonable - if they tried that, you could ask to pay it back in instalments.

Steve - any news on this yet?

 

My case seems to be following yours in that I've had no response from Abbey with just a few days until the end of the 28 day period.

So I applied for a Warrant of Execution yesterday, and opened a parachute account for back-up incase Abbey close my account.

 

My claim was already in motion when the OFT Test Case was announced, judgement was entered without any defence entered.

 

Just want this thing over now so be intrestin to see what happens.:cool:

Try and get the date and time that the Baliffs will be going in and go along and watch the fun lol, hopefully they will settle at this stage, has the court sent out judgement? if so, what date did they send it? Have you rang the court to see if they have applied for a set aside?

:D Rec'd cheque from Abbey today for total amount £650 !!! I'd applied for a Warrant of Execution the day before but makemehabby payed up before the warrant was executed (have to write to the court now to let them know).

 

My claim was in progress before the OFT Test Case was announced. Judgement was entered on 10th August. Chq. rec'd on 31st. No application for claim to be set aside, or for a stay pending Test Case.

 

So if you're claims in progress, keep on movin'. They'll pay up (reluctantly) in the end.

Nah. They didn't enter a defence at all, so judgement was entered automatically. I didn't even get a court date. They didn't reply to the claim at all. Have they responded to yours?

 

From the threads I've read on here Abbey settle out of court just before the court date. I think they're snowed under.

about a week. Then I waited 2 weeks before applying for a warrant. Don't think I needed the warrant tho as they sent the chq the same day I posted my warrant application.

 

Phone the court and ask how behind they are with judgements and they'll give you an idea of when it'll be entered. You can apply for a warrant immediately if you want but as I said in my case they paid up without it.

Halifax 2 N1 submitted 20/07/07 stayed 24/08/07 N244 Application filed 31/08/07 hearing set for 12/11/07 rescheduled for 29/01/2008. Application dismissed stay still in place.

Charity Group £200 compo for lost passport.

HM revenue & Customs; demand for WTC overpayment £632.12. Disputed, their error. Did not have to repay.

well done steve e i'm in court in the morning at 10.00 am abbey have not entered a defence or asked for a stay so I'm keeping my fingers crossed they dont turn up tomorrow well done again mate. chil:)
