I phoned RBS as it took them two and a half months to send a letter saying "thanks we have your letter". They told me (on the phone) that according to FSA guidelines they have eight weeks from the date of thier response to do anything, Are they right or should we proceed to court anyway? The long time scale is due to problems with postal tracking.

Welcome to the site.

Its not your fault that Cobbetts are snowed under, nor their customer services.

If they hadnt taken unlawful penalty charges they would not be faced with making excuses.

If they have had 28 days ie 2 weeks for prelim and 14 days Lba then file for court.

Thanks for your advice. I think they are going to try to stall us all the way, but we have been patient enough, we are determined to get our money back so will go ahead with claim.

  • 5 weeks later...

Thanks to everyone on the site, we have finally won, the money is in our soon to be closed account.

We emailed Sandy Watt to complain about the 8 weeks having expired (it now being 13 weeks) as we had sent our first letter in Feb, she replied saying they didn't get a letter until April, so we sent her the signed recorded delivery slip for the Feb letter ( Ha that shocked her) she replied an hour later saying they had miraculously found the letter and that some bank staff were not passing on letters and that we would have an offer by the end of the week. We accepted and money is the account.

So thanks to all, to all those going for it, don't give up, emailing seemed to be the best course of action as they replied swiftly and it was in writing.
