      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Does anyone know of any other phone numbers for contacting lloyds.

Reason being i sent my Data Protection Act disclosure request for my account on the 17th April (2 days ago) via recorded delivery so basicly i just want lloyds to confirm they have recieved it. I rang 0845 300 000 today but was given two other numbers of which one was just ringing out (01264 8322797) and the other (01264 832915) i tried for about an hour but was flat out busy! Also if by chance they try to blag me and say they have not recieved it which i know it has been signed for (checked on Royal mails web site) what would you recommend i say or do to?

You could try 0117 943 3133, see if you have any luck, but it is very early days yet, I would have given them at least a couple of weeks before chasing.

Hi doz. If you remember I told you i'd sent my SAR on the 17th also. I've been checking the royal mail site but it just keeps telling me to check back later?? Looks like yours is going faster already!

Sometimes that does happen. Royal Mail's website is'nt the best when it comes to tracking something! But yes it does appear that they have recieved my SAR. You could always try calling royal mail just for piece of mind. They should be able to confirm it over the phone.There number is on the website i think. Let me know how you get on.

Just to add to my last post,seems funny how i've had a letter from lloyds this morning saying they have transfered my account over to the collections department!! They gave me an overdraft on the 17th April and i am now paying them £10 a month to clear my arrears! This would be a typical lloyds arsey attitude you think.?

yes i do think. Just checked online AGAIN after 2pm as stated on the back of the receipt and ITS STILL NOT ON THERE!!! I rang the number on the back and it said they are still awaiting confirmation of delivery blah blah blah... and that 'Royal Mal Signed for' is not a guarantee of delivery! So what the hell have I paid for then??? ARGGGHHH they wind me up sooo much :mad:

BTW Doz- did you send your SAR to Penny Berryman or somewhere else?

I rang royal mail again this morning-still no confirmation of delivery!!!

Its a joke. I have to wait until May 5th before I can apply for compensation for lost mail!

Looks like I'll be starting the whole thing again-just my luck.

I have a feeling this isn't gonna go very well for me... :mad:

Hi.

Sorry have'nt replied sooner,i have been dealing with capital one but that's another story.

Sorry to hear that things are not happening for you! Maybe you should think about sending another SAR or giving lloyds a call to see if they have recieved it yet. Just hang in there and i'm sure it will come good on the end!;)

As for my claim(s) ive not heard anything yet. To soon yet i think for my statements to arrive. As for claiming for my girlfriends account ,lloyds now have 7 days left to respond to my prelim letter. Hopefully i should have a response soon but if not i will be promptly moving to the next stage! (LBA Letter).

I did'nt send my SAR to penny berryman,it was sent to:

Lloyds TSB

Box 1

BX1 1LT

Don't know if this was right at the time but i'm assuming if it has gone to the wrong address they will shift it onto the correct one (i hope).

Well I got a list of charges through this morning-but that was all. I think they have sent them as a reply to my first SAR I sent because they are dated 20th April and I only sent the second SAR on the 17th. I dont know whether to wait and see if they send all the info I requested in the second SAR now or just to get this claim rolling with the info I do have. If you see my thread, Monopoly23 v Lloyds, the first SAR was sent on the 14th Feb or something like that, so if this list IS in response to that it's taken them nearly 10 WEEKS!

Right..It's now been 24 days since i sent my S.A.R to Lloyds tsb and so far, diddly squat.!! But, today a letter from lloyds...NOT my statements..:( that would be too quick for lloyds, but ANOTHER CHARGE for £30. Thing is i have been in arrears for a long time now making the odd payment here and there to keep them happy and they were being pretty reasonable with me,even when they were still charging me interest on the overdrawn account. I made an arrangement with them about 2-3 weeks ago to start making regular payments of 6 pounds month to clear these arrears. THEN I GET THIS.....GRRRRRR!!!! :-x What T*****S.!!! What the hell do they think they are playing at..!! :-x I can't believe the way they treat there customers!! I'm livid AND NOW WANT BLOOD!! (not real blood obviously)

Hi everyone..just a quick update.

 

27 days have now passed since sending my S.A.R to lloyds and still no statements. Looking like they may drag this out for the full 40 days but i'll be keeping an eye on the post all this week before giving them a call at the weekend. I am itching to get this claim started. I have checked the previous 5 years on my online account and so far it totals to the ammount of £847 but with 1 year absent. That missing year i think will push the final total up quite nicely (over a £1000 i think) because that was the year i fell ill and could'nt work for 10 months and i remember getting into all sorts of financial trouble.

Anyway i will post again when i recieve my statements.

Oh you better believe Lloyds will take it as close to the 40 days as possible. I am afraid you will have to get used to Lloyds dragging their feet during your claim

Right then..A nice chunky brown envelope dropped through my door this morning which contained my lloyds list of charges (not statements) along with a letter with the details of my account and so on, which looks as though it's been written by a 3 year old child learning to spell at school. Anyway..This is what it reads:

Dear Mr xxxxxxx

Sort code xx/xx/xx

Account Number xxxxxxxx (of which has an incorrect digit)

 

I refer to your recent request for copies of statements on your account to enable you to reconcile your bank charges. Please find enclosed details of charges going back to the date you opened your account, (great,18 years then?)or 1st September 2001,(oh, big difference there then!) whichever date is most recent.

If there are no charges for a certian period then charging details will not be included.

 

You may now wish to proceed with your claim for reimbursement of charges (Oh don't worry..i will) but if you feel you need further statements, this will take longer to access our archived data. Please let me know by returning this letter in the prepaid envelope and i will order them for you.(I might just do that.)

Under the term of the Data Protection Act, we are allowed up to 40 days to fulfil your request.

 

Yours sincerely

So..after looking through my list of charges, i found they only go back as far as Feb 2002 which means their are 8 months missing. Now upon reading the letter which says if there are no charges between certian periods (in my case, May 2001 to Feb 2002) do i now send them a non compliance letter or is it that there is genuinely no charges for that period, or is this a delaying tatic by lloyds.?

 

Also, can i start this claim now with the list of charges i have and then start another claim if there are any other charges prior to these dates..?

Do you know that you had any charges from May 01 to Feb 02? I think its most likely that you didnt if they aren't on there. I would start your claim if you are going back 6 years. If you decide to claim further back in future then start another claim.

Not sure. But my way of thinking judging by how lloyds are being stubborn is they could be using this as a delaying tactic.

I think i will press on with this one with the charges i have and request some statements going back further.

I want to get this claim moving as this is for a reaosnable amount of money,money i could do with.

I am due to have another £30 in charges added to my account on the 1st June. So if i was to send a prelim tomorrow (18th May) and then when it comes to sending an LBA 14 days later (1st June), can i add this £30 charge on at the LBA stage.?

Yes .... You can add any further charges, which you recieve upto the point of Cout claim. If you get further charges then, it will either cost you £35 to amend your claim or another claim will have to be started at a later date.

 

After reading your recent posts, i would crack on as you have choosen to ie begin the claim now but still send for the other statements
