    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Account number not known for closed account with Barclaycard. SAR sent with LOADS of info 13 MArch. Reply received from Tim Young saying can't find your info, your a/c probably deleted. From 2004? I think not ...

My bank kindly searched payments made to Barclays, Barclaycard and Mercers; after a long time, they found MY BARCLAYCARD ACCT NUMBER.

Called Mercers who gave me Barclays DP number. Called lSue Brown on 01604 254663/254518 who said that will do fine to get your statements to you.

Interestingly, she asked me if I'd included my 'phone number and when I said I had, she sounded surprised.

So, reminder SAR sent to Tim Young today by registered post. They have until 27 April to comply but I anticipate a long wait as I understand from these threads that the Barclays organisation regularly flouts the 40 days rule.

Hey ho ...

40 days end today. However, they may need longer to get my data together from receipt of my re-discovered a/c number on 20 April.

In which case, in 7 days' time I would send LBA giving them 14 days to supply the data before beginning a complaint to the ICO.

Any thoughts anyone please?

Hey Painty!!!!

How Y'all doin there?! I miss ya!

Just to let you know that Barclaycard have been total SH*ts with me too.

They reduced my limit from £500 to £290 (what a weird figure???) & requested immediate payment for the amount now "outstanding"!!

Then I got a letter a couple of days later saying.."we are giving you £244 of your charges back Being credited to you today".

Mmmmm, that would be enough to cover the amount now outstanding from the drop in my credit limit then!!!

OUTRAGEOUS behaviour & dreadful tactics dont you think!

Oh & Capital one still decline to give me all my money back so I am able to file MCOL now. (didnt have the money till now!).

I had a look at your POC today & there is alot of characters! Did your file an N! via the local courts I cant remember??

Oh, & some good news! Husband & I got our £3000 back from Barclays last week - our first successful win! Yee-Ha!!:D

Hi Paintball, are you just claiming 8% statutory with this one or are you being brave and claiming CCI?

Hi lemony :D

Have got my statements and was just going to claim 8%, have done spready and now can't decide whether to go with 8% or CCI. Have not had time to follow any threads on barclaycard so am not sure how they react to CCI, any thoughts?

LBA sent today in which I reiterate my request for return of all charges and interest, together with removal of default and adverse markers from my credit file. I'm so fed up of the prejudicial information held against me as a result of unfair and unlawful charges, that I'm on a mission to have ANY such info removed, no matter how long it takes me!!! Grrr

  • 2 weeks later...

LAtest update for me:

I have done things with Barclaycard: 1) asked for a full refund of charges together with removal of default and adverse markers on my credit file and 2) written to Barclays' Company Secretary requesting the latter and enclosed a Stat Notice which reiterates and is intended to reinforce this request.

I have received a prompt initial response from Barclays re the letter to the Company Secretary; letter plus 'phone call from his secretary promising that it will be looked into.

Re my LBA, Mr Andrew Yau has sent me his statutory salutation "Sod off, you can't have any more money and our position remains the same ..." He does not, however, refer to my request for removal of default and adverse markers.

So ...

I will give Barclays the rest of their 21 days in which to deal with the default issue and thereafter will be processing my N1 and including reference to removal of the default/markers.

Anyone else in a similar boat to me?

P :D

Does anyone have T&Cs for B/card for 2000 to 2003? I've posted a separate thread on this and really could do with getting hold of them.
