Hi, I have just subscribed today after following the site for several weeks. I complained last year to my bank HBoS about their excessive charges. Now received two letters saying they will look into my complaint. I will not wait any longer for them to fob me off again and have raised a claim in the sheriff court for £746 plus interest and costs. Will await with interest to see wghat HBoS do next. I believe that all banks have brought this situation upon themselves with their high handed arrogant attitude.:mad:

I raised an action in the sheriff court against HBOS for bank charges, and the week it was due to call, received settlement of all but £30 that I had claimed. I was at cost for raising the action and although deciding to accept the principal sum, I advised HBOS that they were due me costs. I had no reply to my letter and went back to court for the costs. The court granted a decree agains HBOS for the costs and I again wrote to HBOS advising them that a decree for costs had been awarded against them Once again, no reply was forthcoming. I have written again, ten days ago, and as yet no reply. Do I keep writing them, probably to be ignored, or do I go back to court and seek that the court enforce the decree. Any advise will be welcome.

If the court granted a decree. Then eventually they will give you an extract for payment that you have to get a sheriff officer to deliver you have to pay their costs about £ 31 of course you will get that back plus the interest @ 8% annually for what is due you. It does take the court a couple of weeks to get the extract to you, but it is quite simple. Good luck

Quite agree, the cost issue is not my problem. I have now contacted the court and have been told that the baliffs should be instructed by me to enforce the decree. That will be interesting to see them appearing at the bank branch to get money from them.

Have now spoken with bailiffs. It will cost a further £31.37 to enforce the decree. The bank is HBOS and at Forfar in Scotland. I will not know when the bailliffs will appear at the branch as they will undertake the instruction in the daily course of their normal business. It would be nice to have the press photographer on hand to record the event.

Can you keep in touch with the bailiffs and get a 'nod' when they're going? I'm not too far away and I'd love to see it. Also if the press don't want to come - I've got a camera!!!!

Probably more of us out there who would turn out too!
