Hey

 

Ok so far ive sent my request for payment off for £165 and ive received the letter below. Is this just a standard letter i take it??

 

Should i reply to the Andover address ive been given on this letter now?

 

Also just a few newbie questons.. If i went overdrawn at a time more than £30 and they charged me £30 for it i can still claim that back yeh?? and also if i win in the end would they close my overdraft beacuse of it??

 

Any help would be great so i can move to the next step

Like any Business we do make a charge for some of our extra services. When customers dotn have enough in their accounts to cover a payment, this always means extra work - and it happens very quickly. We have to agree to make the payment by setting up or increasing the overdraft, or tell customers we cant agree it. We feel its fair ro charge for this service.

 

Of Course its only fair too, that were completely open about any charged-for-services before you mite need them. Thats why we take care to give every new customer the latest guide to our charges. You can also get upto date details about fees and borrowing rates at all our branches, through our helpline and on our website.

 

Just as importantly, we do everything we can to help our customers avoid these charges. You can get an up-to-date balance at any of our cashmachines, over the phone, on line and by weekly text to your mobile.

 

If you know a payment is going to take you over your agreed limit, your welcome to see if theres anything we can do.

 

The office of fair Trading has published new guidelines on creditcard default charges. Were still talking it through with them, but the important point is that the guidelines are about 'default' charges that people pay when they break an agreement with us. This doesnt apply to your charges as these were for dealing with your request to go over your agreed overdraft limit. They are not default charges because you havnent broken your agreement. They are our prices for the service we provide in these situations.

 

I Understand that you may also have some concerns about us sharing information about your relationship with us with the credit reference agencies we use. Id like to reassure you that this does not apply to bank charges; we only share what is known as white data which is information about payments to your credit card, loan or mortgage accounts.

 

i do hope you can see that we make our charging system as fair as possible and why i cant agree to cancel your charges

 

I hope this fully answers the points you raised with us. Please let me know if there is anything else i can do to help. If we cannot come to an agreement, i will provide you with details of the financial ombudsman service so they can consider your complaint independently.

 

If you are happy with the way i have dealt with your complaint, there is no need for you to reply to my letter. If i have not heard from you by the 11 jun 2007 i will close my file, though of course I will re-open it should you come back at any point afterwards

Hi robolint, did your request state any time limit? if it did, and the date has passed carry on with your next letter (LBA) and send it to Debbie G.

Not sure on the OD, maybe someone else can answer that for you I would suggest be prepared for anything and open ;) a basic account at another Bank/BS

it said the normal 14 days. I dont think its been 14 days yet so shud i wait until then yeh?

:) Hi robolint, now you get the standard letter back,:) so familiarize yourself with the FAQ's and ready yourself for the next step. I am helping my daughter reclaim £135, no response from the LBA, so she will be taking the claim to her local court on monday. Keep checking your account, as some people have had monies paid in without notification (lucky things:) )

Ok 14 days is up 2morrow and ive heard nothing

 

I really want to make sure i do this next bit properly so wud anyone there allow me to add them to MSN so they can run me through it all and make sure im doing everything as it should be?

 

After hearing lloyds won i dont wanna mess up

 

Oh quick question as well... if u lose the case what do u actually lose yourself? Is it just court fees or is there more? Any advice wud be great

Hi Robolint,

are you now at the moneyclaim stage?

 

to answer your question, if a case is lost then you are not liable for any further costs as these claims are usually in the small claims track, so all you would loose would be your costs. But it wont come to that foolwo the steps in the guidlines and read all the FAQ's and you will be fine
