Hello everyone, I've followed the advise is the CAG Faqs, I am at the stage when Abbey say they have completed a full investigation and confirm the charges were applied as I had insufficient funds available. Also that they are satisfied that the charges do not contravene the UTCCR 1999, and comply with the OFT, also,the charges are based on extra admin work involved when an account has insufficient funds to meet a payment and should I remain unhappy I can write to the Fin' Obs'.

Was this a standard fob off letter?

Abbey regret, that they are unable to provide a breakdown of how charges are apportioned, I emailed Abbey to remind them that without specific proof of the true cost, their charges may be unlawful and that I will proceed with my claim for the return of my money via the courts.

I am claiming back £475 on an account Abbey closed, once cleared, 5 years ago.

The charges were for cleared transactions and unpaid DD's.

Is there anything else I should or can do before MCOL.

This is a typical fob off letter that the banks are using in the hope that the claimant will go away.

 

As you have requested that the charges be repaid to you and they have refused then I can see no alternative but to use MCOL.
