      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

The judge orders that you and the other parties prepare for trial as follows:

1) The claimant shall by 7th May 2007 send to the defendant and to the court:

a)A schedule setting out each charge repayment of which is sought, showing the date, amount, and reason given (if any) for that charge to be made;

b)Copies if statement or any other document relied upon as showing that each and every charge has been made;

c) A statement of evidence of all matters relied upon as tending to show that the charges are irrecoverable as penalties or otherwise;

d) Copies of decided cases and other legal materials to be relied upon.

 

The defendant shall by 28th May 2007 file and serve a response to the claimant's schedule, stating in respectof each item claimed.

a) Persuant to what contractual provision such charge was made, producing a copy of the contractual document relied upon;

b) Whether such charge is accepted to be a penalty, and if not why not;

c)If such charge is alleged to be a pre-estimate of the defendants loss incurred by the claimants actions (whether or not such action is treated as a breach of contract between the parties), all facts and matters intended to be relied upon as showing that such was a proper estimate of such loss, and all evidence to be abducted at trial as to what the true cost of dealing with the matter was;

d)If such charge is not alleged to be a pre-estimate of the defendant's loss incurred by the claimant's actions then facts and matters intended to be relied upon showing the basis uponwhich the charge was calculated and all evidence to be adduced at trial as to show that the charge was fair and reasonable.

e) Copies of decided cases and other legal matters to be relied upon.

I am a little bit cautious. Part of the claim is Pre- 6years and i am hoping that the judge (bless him) who has not made any specific mention of the limitation act and has concentrated on them disclosing the true cost of their charges.

Pliny, Yes i tend to agree with you over calling their bluff. But i've learn't on here to keep your focus. In fairness he seems to have gone straight for the jugular.

It's not for the DJ to mention limitation. It is either for you or the defendant.

 

If they don't raise it in their defence don't mention it but be prepared to argue it as part of your response to their defence if they do. Also be prepared to argue it in court if they try & spring it on you then

It was raised in their defense, but the judge has not made any specific point to me to prove the part of my case under the limitations act.

Scarborough. I sent the new amended AQ, but he seems to have done it his way. Yes vitually the same, word for word. They ask all the right questions. Is this checkmate ?

Fendy my virtual buddy. Thanks for your support. Their is a sort of virtual madness that quite often bubbles to the surface. The emotional bashing we all take on here is sometimes so over whelming. Their are alot of superb people on this site who continue and i'm sure will continue to fight this totally just cause. Amount claimed 7k.I am very interested to see for obvious reasons. ( seven thousand of them ) Whether Cobblers throw the towel in or if your reading this Nasty West. Waste more of your money which surely by now you ( Nat West ) must have realised is a very plentiful

gravy train for Cobblers. With absolutely minimum success.
