Hi everyone need some help. going through old stuff in office today only to find old statements for my old bussiness. I found that I paid thousands in fees,£360 in one day (can you believe). Now I have few questions. Firstly the template for bussiness sar request does not refer to pre six years is there a template? secondly the nat west have just ripped me for £20 K (long story) so my way of getting a proportion of this back is by charging C I interest but for some reason the templates I found I dont seem to be able to get into. CAN ANYONE HELP:? :? :?

Hi sharpgun

 

If you have the statements you don't need to send an SAR. Just modify a template to produce an initial request for payment letter with a suitable list of charges attached. Add interest too if you want although NW will fight that. They will cave in eventually though.

 

Post a draft letter here (with names, account details changed of course) so that others can comment on it before you send it if that would be helpful.

Halifax - £2281, successfully refunded all charges after LBA letter & telephone call.

Have been offered the difference between the £20 and £12 charges from Capital One -- am sending LBA for remainder.

GE Money - Received settlement of £441, being total charges requested. No interest though.

CCA'd Bank of Scotland / Blair Oliver Scott to produce CCA Agreements on two Credit Cards - well in default, although still chasing payment!!!

EOS Solutions "ceased action on account" on behalf of a friend.

 

All in all, quite busy at the moment and enjoying every minute of it

just thought i would add up my charges ,and some questions have come out of this.firstly my manager moved to a different branch so the account NUMBER changed does that mean i have to do seperate claims. secondly each account period totaled approx £4k each this did not include the interest they charged me. thirdly in black and white at the bottom of the statement it clearly states i am getting charged 29.5% should i go over my limit. (So they charged 29.5% interest for any anything over the limit £3.50 a day for being over and a fee !!!!!!!!!!!!) does this mean I can charge them the same. 29.5% of 8k qver 15 years i think is a lot of money.

Thats the million dollar question. The banks will push you to the very limit over the interest issue, because the rewards for you are huge and the losses for them are also huge. The main points are if you claim interest, claim it from the very beginning.

That way if they make you an offer it gives you manouverability to reject any early offers. The old chestnut still applies. The charges were taken unlawfully from your account and you have a legal right to claim them back. Time wise i would b e tempted to go for the whole lot. The limitations argument is slowly but surely being eroded. Loads of interesting threads. Good luck.

Hopefully a link to a useful couple of threads will appear in my signature.

Firstly, a group of us have started a thread to help all those claiming against Business accounts. We've got together to share ideas, methods, views etc .

There are some subtle but VERY important differences regards claiming against Business accounts; mainly the fact that you cannot use Consumer law, (but there is plenty of other legislation, regulation and case law you can use)

I too am claiming on a Business account, and for prior to 6 years, and including Contractual interest.

Yes, the figures involved can look shocking at first...... but remember, this is exactly the same way that they have charged you, and then also gone on to use your money to acquire massive profits from others!!

Do not let the sums appearing deter you, remember that the law is very keen not to allow wrongdoers profit from their acts.

Secondly, in my sig. should also appear a link to another thread regards consolidation loans.

Like many here, you may have been forced at various points to take out consolidation loans, mainly to repay borrowing from the Banks. In many cases, much of the borrowing is in the form of overdrafts that consist of lots of charges. Had you not had the charges in the first instance, you would likely not have been so overdrawn? So, in effect, you've firstly paid interest on the overdraft caused by charges, ...and then gone onto pay interest on a further loan to clear charges that you should never have had in the first place !

Many are wising up to this double blow, taking actions, and have won. So, if this has also been the case for you then join in.

hi photoman i found a spreadsheet earlier for compound interest laft the computor on went out, and had a power cut. and cannot find it help please it was so good seeing those big numbers i think i put in 210 worth of charges and it had already had totaled up to 12k, theres another 7800 to go whats that gonna come to?

Do your sums and total things up......... but before you go ahead and file your claim, remember to have a good read up on Contractual Interest, and all the arguments and reasonings. It is a lot more complicated than simple statutory interest, so you do need to make sure you know what your doing, why, and how to argue your reasonings with confidence.

cant believe this is right have added £500 in fees totaling 22k inc interest my total will be 4 or 500k is this right this is gonna bevery interesting

yes 400 to 500k i am just guessing that figure but i have put £500 into the ci spreadsheet and i have another 8k to go in.In those days i had a bookeeper doing my books and it was nothing to be 400k overdrawn, so i didnt pay much notice

Were you in your unauthorised rate all the time ? You will also have had an authorised rate. This is the rate that might have changed over the years.

We got round any argument about interest rates on our claim against Nat West by claiming the actual interest charges from the statement whenever the overdraft was less than the total charges so far, which was always after the first year. If the overdraft is greater than the total charges so far, then you just pro rata the actual interest charge.

 

In that way, you are always effectively using the same rate they charged you.
