I've received a defence from Cobbetts today (18th April), i don't see a mention of a CPR part 18 request. It's 4 pages long and it doesn't make sense to me.

 

"the Particulars of Claim do not disclose reasonable grounds for bringing a claim against the Claimant to recover the bank charges (and interest thereon) referred to in the Particulars of Claim or any other sum(s).

 

In the event that the Claim is not properly particularised then the Defendant will apply to strike out the claim and/or for summary judgement in respect of the same."

 

To me that says that the particulars have no grounds for bringing a claim against me - as i am the claimant.....

 

Can anyone help with this?

Thats the way that I would read the first paragraph but with the way that lawyers speak it may have other connotations.

 

I am sure that one of the mods will be able to fathom out what they are saying.

I have realised that I didn't send the schedule of charges to Cobbetts as I've already sent 3 copies to Natwest and there should have been a copy included with my claim when it was served. Is this anything to do with this defence?

Is there any harm in me reproducing the defence on the forum for others to look at? It doesn't appear to be a standard cobbets defence and I think they are trying to say I haven't supplied a schedule of charges, which I sent to natwest and the court when I made my claim. I haven't yet sent one to Cobbetts as I was under the impression one would be included with the claim.

Yes no problem with putting defence on forum. Make sure you delete your name, account and case number out.
