Hi EveryoneI have seen some real interesting comments and advice regarding bank charges ( Barclays in my case ).It has now been about 60 days since I hand delivered letter requesting last 6 years statements for my wife and I . They said they wouldn't charge me the £10 but would still send me my details .I am still waiting for info I have logged a complaint with Barclays for which they gave me a log number last week and have also emailed a complaint to Info/Commisioner last week (Thursday) . I don't seem to be moving much on this.Can any one suggest what I should do now , would be really greatful ....

Please find your banks forum and start a thread;

I think its about time you escalated matters, as Barclays are extracting the urine now.

 

Send them this

I know its scary, but I think after 60 days you have to seriously consider this. Obviously, you have to be comfortable with this, and if your not, then don't do it, but how much longer will you put up with them stalling you?

Hi,

 

I think you have been stone walled a little.

 

Under the Data Protection Act two requirements have to be fullfilled to enable a complaint to be correctly lodged and for them to comply.

 

Under section 7 of the data act you will note it says, it must be in writing and must accompany the correct fee or they do NOT have to comply and while you were told at a branch that you may not have to pay, this is often incorrect.

 

The Data protection Act is here.

 

Data Protection Act 1998

 

So you have two options -

 

1) Write a letter stating that the letter was delivered to the branch and you were told that the fee of £10 was not required. You therefor believe they are in breach of the data protection act and enclose the £10! giving them another 14 days.

 

The letter template for this is in the message from Louis.

 

2) Start again.

no i hadnt forgot the 2 days ,thanks anyway.Will start thread in Barclays section when things start kicking off.At the mo im still waiting for my 6 year statements...never know they may turn up just before the 40th day.

Thanks to everyone who has responded.When I hand delivered both letters requesting statements I got a Barclays Business card from the Girl with her name on she wrote on it she has accepted money £10x2 and letter, but rang me in the afternoon to say she would credit money back into my acct as Barclays would provide this info for free .I am thinking about sending DPA non compliant letter.Any thoughts

Hi manni,

You should send the DPA Non-compliance letter by Recorded delivery!!

Do not wait any longer if you are not firm with them they will use this against you when making settlement offers.

 

Remember send recorded delivery to their head office address but for good measure take one in to the same branch that you took you original letter into.

 

Dont worry about the court process the evidence that is required is all factual and is not reliant on your opinion or you convincing a judge.
