When I recieved my banks defence through the post it said there would be an AQ enclosed. There was not so I rang Northampton County Courts helpline and a man said " oh i don't know how that happened I will post 1 out to you 1st class". I said don't worry I will get 1 when I go to my local court (Canterbury, Kent) today, fill it in and hand it in along with my schedule and a copy of my statements.

Off I trot to canterbury crown court, where I am informed that Canterbury judges have had so many cases like ours that they no longer bother with AQ's and they just look at the case in due course and decide whether it will go to a hearing or not. This apparently won't be til July at least. Has any 1 else encountered this?:eek:

a few people seem to be getting this sort of thing now - heard last couple of days that my DJ is dispensing with the AQ

DCA's - they have the same power as an infinite number of untrained chimps working on a script for Hamlet, but the chimps would probably at least get it right :D

and our advice is to take the time you would have spent on an aq - and write a nudging letter to the solicitors instead. couple of samples in the New--after.. link above and also in the After you've filed your AQ thread found in the forum list. The courts want resolution, you want resolution - show you are happy to resolve - rework the letters and send one every 10 days until they offer.




p.s. would you like to get your thread moved to the barclays forum? you are certainly welcome here - but you'll get more specialised help there - like contact details for their solicitors, etc.

i'll ask someone to move it - if you want - then you can always pop back here on one of these threads for more advice if you want

I have now received from my local court a letter saying that my claim has been allocated to the small claims track. Which is fine but it also says that before the claim is listed for a hearing the judge has ordered that a preliminary hearing should take place because "special directions are needed in this claim to prepare for the final hearing which the judge would prefer to explain to you in person". Anyone have any idea what this means???
