hi here is some more of the content of the letter i received today.

"Unfortunately, we are unable to supply a list of charges applied to your account for the last 6 years because we do not store this information seperately from other transactional data.We can only supply a list of the transactions on your account, which will include details of any charges applied.

You have also sked for details of any "manual interventions" that there may have been on your account. Although I am not entirely cleaar as to what information it is that you require, I am taking a "manual intervention " to be any action taken with regard to your account other than an automatic or computer-driven action.

You will appreciate that, first of all, not all manual interventions on your account may be recorded. For example, if a member of staff looks at a paper document relating to your account, a record of that activity will not always be made. Moreover, an "intervention" may be carried out by any one of a large number of departments in Abbey. There is no central record of such interventions because this is not the kind of information that we usually need nor, more importantly, information that a customer would normally request.

 

I regret that i am unable to supply detailed information of any manual intervention. I am sorry for any inconvenience this may cause."

Just a standard letter, with the usual 'manual intervention' rubbish.

 

At least now you can add up your charges and get the initial request sent.

 

I wont mention the statements(;)), I'm far too polite:).

still feeling stupid , but there you go, anyway after all the

unnessercery waiting i am about to write the letter I should have done in Jan .I think I have it right its the prelim isnt it , and dont mention the interest .

For such a small amount Im hoping they will just go ahead and pay me out without all the hassle.:rolleyes: I should be so lucky eh:lol:

sorry to be such a pain but this interest thing is doing my head in.

Im confused about which rate to use . Its got on abbeys site the unauthorised overdraft rate is 28.7% EAR .do i use this to claim contractual interest or would statutory be better.

Help I havent a clue about this but I am trying to work it out

Well,

 

There are various discussions on-going about interest.

 

The 8% interest is set by the courts, and is the standard amount claimed (and is what I've always used, thats not saying its the bast way though:) ). I'm not the greatest expert on CI:confused:, except that t needs to be claimed from the beginning. I will look for a few threads on the subject, that way you can have a read and see what you think.

I think the thing to do, is scan them and pick out the relevant bits. I'll be honest, I wish I had looked more closely at CI as I think its worth investigating, and there have been some very good sucess stories. On the other hand, there have been some disasters, albeit in the early days.

 

Has to be a judgement call, and thats where the homework comes in. Have a particular read of anything Bill-k says about this, he knows what he's talking about, and just happens to be a nice guy as well.

Thanks for the help Louis, I really appreciate it. Dont know what id do if not for some of you guys on here.Your links are scanned and youre right thats my w/end tied up.Oh well who wants to go boogie when they can be at home reading all this lovely bumf? :lol:

I could sit and read on this site all night some of the threads have me so engrossed that i forget the time and before i know it it is the wee small hours, if im honest ive even fell asleep at my comp . Its such a compelling site, im really pleased i joined.

Hi can anyone help me with this question.

Do all the banks charge the same interest rates or do they differ from bank to bank.

Im tryin to find the rates for the Shabbey. I thaough I had a copy of them somewhere lyin about but cant find them and the local is closed now.

What I was thinking is if I made out a few spreadsheets and then I could decide which one is the one to go for.

This is a bit ambitious for me but Im willin to have a go and see if I can do it .

Sent Prelim to abbey today cause upon reading over what I thought Id sent Id only sent them the DPA so its the prelim next, right.

Ive not heard off them so I presume they are not willing to contact me as yet.

Sent schedule of charges with letter. I was finding it really difficult to work out the interest on my account but found a spreadsheet on Vampyras site and it all seemed to fit into place, even for a dumb cluck like me. I think those sheets are magic, the way it automatically works everything out for you.

I have done 3 lots of interest calculations

a) charges with interest

b) 8% one

c) compound & combined charge and interest.

 

Although my claim is relatively small compared to some I was amazed at the differencce c) made to the total , especially to the claim ive put into the Halifax.

Im just hoping ive done it right lol, going on past experiences ive probably c****d it up, old age creeping up I think.

Dont want to appear stupid but, if you put the schedule in with the letters to the bank just claiming the charges with interest paid on charges , and it doesnt go to court then how do you go about claiming the combined one ? Do you submit these to the bank if they decide to settle out of court or if it gets to court but they dont show is it then up to the judge to award you what he deems fit?

Cant get my head round that one , do you have to settle for the one you originally submitted with your letters?

Anyone got any comments id love to know the answer.

I'm not the greatest expert on compound interest, but if you are going to claim it, you need to include it in all correspondance, starting with your preliminary request for payment. So if your going for it, you will need to send a revised preliminary request.

I am seriously thinkin of changing my user name to "BRAINDEAD" now.

Ive been sat at this comp for 5 nights , nearly all night, and I still cant get my head round all this interest lark.

Ive used Miandsia's spread sheet and ok just when I think ive cracked it i read on another thread that someone with a claim for a smaller amount of charges than mine has a whooping big claim using the compound interest spreadsheet.:confused:

Im just about at the stage where im thinkin of givin up :(

I must be doin somethin wrong but i'll be jiggered if i know what:x

Ive read and re-read the thread "Why is no one claiming contractual interest" but i still cant make head nor tail of it all.

I think the one brain cell has decided to migrate downto my toes or somethin. I wish i'd taken more interest,(pardon the pun) now at school in maths. Didnt realise how thick i must be.:eek:

Oh well back to the drawing board as they say. Im planning on sending the shabby another prelim with an amended schedule of charges ,WHEN i can fathom this lot out.

Ive waited long enough now a few more weeks,months, years, wont hurt lol. Whatever it takes ill work it out sooner or later.

Just an update ive just decided that perhaps i did the spready's right after all.

been sat at the comp nearly all day (again) and reading reading reading. Cant get enough of this site, but if you think about it its better to find out as much as you can so your forearmed.lol.

ive decided to send my LBA into the shabby with an amended schedule of charges. I think its ok to do that at this stage , sure ive read somewhere on this site that other people have done it so going to have a shot at it myself;)

ive printed off another 3 lots of spreadys one for each type of interest but ill just send the one for contractual in and then include the 3 lots in the bundle (if it gets that far) then leave it up to the judges discretion.

Just an after thought and i hope this doesnt sound to dim but when you get the statements back are you supposed to get the contract you signed as well and any other info they keep on you like if there has been any "manual intervention" or is it just the statements:confused:

The standard sars request is statements only. As to manual intervention, they probably sent a letter saying it was impossible to measure blah blah, which means nothing, so don't worry about that.

Honestly Ive been meeting myself coming back over these interest rates and the spreadies.:confused: I only hope Ive got it right this time !

I felt such a fool the other night I asked if anyone could check a bit of my spready and instead of scanning it in I copied it. DOH! Talk about was my face red. It looked like a right load of jumble, nobody would have been able to make heads or tails out of it. Someone said it was the best post all night:rolleyes: Yep I think they were being sarky but I couldnt help but laugh. Couldnt blame them though.

Oh well we live and learn dont we.:D

I don't think you'll be the last to have problems with interest and spreadsheets. I remember dreaming about them the first time I used it.

 

Quick question, what made you go for CI? I am flirting with the idea for my next claim, but haven't really had time to look at it too closely. Has it made a big difference to the amount of your claim?

Well I just thought that they have charged me so why not " DO UNTO OTHERS". Its my money and now I want payback. That might sound brave but Im not feeling very brave at the moment , although, I have just read "ME V HALIFAX" and for the first time I think I understand this interest lark a whole lot better. Applied this formula to my charges and POW it worked. CI wont make a huge difference really but the satisfaction will lol.:D

Hi all

Just to update . Ive not filed this claim yet as ive got a claim going for halifax and to be honest could not afford te fee yet to do this one as well, (still not working).

I had a letter off them yesterday to say they wre investigating my complaint .

I am ging to try and file soon BUT just checked my account with them cause I think theyve just bounced another d/dand lo and behold i find they have refunded me £240 .:confused:

 

No letter telling me they have done this so do you think I should write to them telling them that I will accept this as part payment but will still file or tell them to take it back.

 

Dont really know what to do,

 

Any suggestionswould help.

If someone could advise me what to do now that the bank has put money in account without notifying me i'd be reaaly grateful.

14-06-2007--Received standard Bog Off letter.

13-06-2007--Took N1 to Local Courts.

26-06-2007--Copy of N1 from Court, issued 21-06-2007. to Halifax, Deemed Served 25-06-2007

Have till 09-07-2007 to file Defence.

Hi there overflow, I expect you will receive a letter very soon, about the amount credited to your account. The same happened to me last week, although I told the over the phone that the offer was a joke and refused it. They still seemed fit to credit it into my account. Today I received a letter with the usual crap sent to others. I believe there was a postal strike late last week. Maybe your letter is delayed.
