Rang the courts up yesterday only to be told that there was no sign of my papers on the system yet. Asked when I took them into the court I told them the 13th , then she asked how much Id paid told her £120 , she went off the line then came back and said that there was a pretty big backlog for the local court for Halifax so not to worry and to ring back on Friday.

 

I was hoping to have heard something by now but , hey, Ive waited this long, a while longer wont hurt, all the while the interest is growing so what the heck.

 

Im not really bothered , the only thing that is p*****g me off is that I went ahead and put in for CCI and now I know that because I did it from the M&R aspect that I wont get it ,what with that "dads" case setting a precedent.

Had I of gone along the lines of the banks in my mind being a fiduciary then perhaps I might have been able to argue thar point,but, I didnt so tough titty on me.

 

There again as long as I can claim some of my money back then I dont mind too much and the next time I go for another account to claim from Ill know just what to go for , I think:rolleyes:

 

Have you heard anything yet. Its the waiting that is the worse part isnt it. You will presumably get yours before me I hope so you can fill me in on any details you think I might need to know if you wouldnt mind that is.

Hi overflow, don't worry, as you say the interest is building up, so that's another thing in your favour, not theirs.

I'm not sure how long my one will be, the chap behind the counter at the court, had to look at the calendar, when he told that it should be 3 working days, (mind you it's only 24 hours longer than MCOL) I'm just keeping my fingers crossed that he's right, if not, then my interest will add up to a bit more, hahaha.

Joking aside though, you never know, but you might just be able to get that CCI!! you'll have to keep us all posted on that as well as the rest of your claim.

Yes, you're absolutely right about the waiting, it's enough to drive a person crazy, &/or to drink. I wonder if money has any of those "chill pills" left for ushehehe.

Hi all

To update ive come back from the shops and found the postie has delivered my papers from the court.

The banks shall be deemed served on 25th June and they have till 9th July to respond.

Im excited now but also a bit wary, as you all know Ive gone for CCI but dont think Ive a hope in hell of getting it now, just wish Id read Dads thread before I took mine to court. Never would have gone for it then.

Still Ill be happy whatever I get , just the immense satisfaction of standing up for myself, at long last. Im still gob-smacked that Ive actually been and gane and done it. Didnt think I had it in me . Its all down to the fantastic people on here, without whom I would never have dared try anything like this, yet now, well Im rearing to go.

Could someone please tell me though should I have put my costs : expenses and the time its taken , stuff like that, on the POC or do you claim for that if and when it goes to Court or if the bank rings to offer settlement? Not too sure on that one.

Ive just claimed the CCI on mine dont know if this is right and if it isnt then when can I claim for them?

Any advice would be most welcome

Hi overflow, just read your post. Now then whoa where to start, yep got it, great news about your papers, might just be the same date as mine, (according to man behind counter at court), fingers crossed. You mention the CCI, you might never have known one way or t'other (bit of Yorkshire there) as to whether you would get it or not, so, personally I think you're right to go for it! Like you say, you've got an immense sense of satisfaction for "standing up for yourself", its a great feeling ain't it.

Yes, you should have put all your costs i.e. postage, court fees, & 8% interest for all the penalty charges that they owe you. So, I don't think you can now, unless they are still charging you for unpaid DD's or whatever. Really, I think the best person you need to ask is SSL, as she knows much more than me. I'm sure she won't mind if you PM'd her.

If they're still charging you, then you might be able to put in another claim, & get it back that way, but don't quote me on that one. Yes, hopefully we'll be hearing something soon, just gotta keep checking that account of yours, I know I am.

I'm the same as you, as I'm on Incapacity Benefit, have been for the last 3 & 1/2 years, had to have 2 ops to remove a couple of discs from my neck, & there's a very big possibility that I might have to have 1 on my wrist, as I have a constant numbness in my hand & arm, lol. So, the fact that they have taken money for unpaid DD's is illegal, as it came out of my benefit money, I'm assuming that's what they have done to you also.

Im not on benifits just not working. Had a job 2 &1/2 yrs ago but walked out and just been in and out of work since. Me and my stupid impulses.

Im sorry I walked as cant seem to get a good job now , not qualified for anythin , jack of all trades done a bit of everythin. Trouble is now the money is wearin thin on the ground but no sign of a job, Im sure its my age only got another 3 yrs till I draw my pension . OMG ill qualify for a bus pass.

Where does the time go. Seems like yesterday that I was just 21 , Still feel the same but now the old face looks like its been torn off scrumpled up and flung back on. LOL:)

Same here, I've also got hot flushes to contend with. I'm looking forward to my 50th in 18 months, but not the fact that I'm gonna be 50, but the fact that I'm going to Benidorm for it, as I've got some friends over there, who my ex-husband & I grew up with,& they & their wives actually own their own bars, so I'll be drinking plenty of this stuff.

 

Now there's a thought, how about a get together in Benidorm, lol!!

Me too, yesterday I tried to do something I used to do when I was in my 20's & fell off the doormat, (I can hear you all . I was carrying an armful of washing, & rushing out of the back door, & misjudged where the outside doormat was, besides that the flaming dog had moved it away from in front of the step. Did I read your thread right Ja-De is yours deemed today aswell?

 

They have till the 9th July to pay up or file a defence. I just hope they think it isnt worth going to court for and take pity on me and put the money in the bank. Well a girl can dream , cant I. Would be ssssssssssssoooooooooooooo nice o check my bankand find a nice little deposit there. LOL

 

Have you started getting your bundle together yet just in case?

I dont know whether to start mine or not yet, suppose I should as when Iv read other threads on here they have got so much to put in them.

 

You remember me sayin that I havent put the cost of the postage or that in my POC's , Well just thought then. Ive not done the bundle yet so I couldnt put the cost for the time it takes to do that in the POC's before hand then could I.

 

Perhaps I can still claim for that when they settle then ,(if it goes to court I could ase judge to include the costs then ) . Cause cant see how I could have included it if I havent done it yet.

Does that make sense or am I waffling on again:confused:

Yes, if it's right what the chap at the courts told me, it should be todays date, will have to wait & see on that one, as soon as I get mine back, I'll let you know.

Not too sure about putting costs & stuff extra on the bundle, hopefully SSL could put us right on a few things though, it might be OK, just daren't say, as I know I would be wrong if I did (that's me waffling now). I haven't started my bundle yet, but, don't have much to put into mine, just a couple of penalty charges & interest, & postage.

I'm even thinking seriously about moving everything over to my other bank, as I don't really want to stay with haliprats any longer than I have to. I've lost all confidence in them.

 

Getting back to what you were saying about not being qualified for anything, when my marriage broke down I tried, no end to get a decent full-time job, but because I wasn't qualified I had no chance, so I went to college for 2 days a week & got an NVQ in tailoring, worked in tailoring for 4 years. Did 5 years as a picker at a book company (where I had my accident) & took voluntary redundancy. Since then I've done 2 computer courses for word, spreadsheets internet etc, & passed them both, so now I'm just waiting to get sorted with the hospital & get a decent job in an office, & then hopefully I can have my independence back.

First off I want to say. WHAY HEY GIRL . Good on you , sounds as though you know exactly where you want to go and by the sounds of it , youll get there too. I think its really great that you got your head on right and went out and did something. MORE POWER TO YOUR ELBOW!!

 

Am I now in the presence of some computer genius then. How on earth did you get your head round spreadsheets. I must admit Im really, really impressed.

Wish I had the bottle to do it but I feel at my age its a wee bit too late now, although I would love to learn more about this comp I dont think anything would sink in . Things these days just see to go floating out of my head as fast as I try and put things in. Goldfish memory half the time, honestly.

 

My late husband was the one into computers, He was self taught and before his health problems he ended up teachng computer techniques in a local college , and my son now takes after him . What he doesn know about comps just isnt worth knowing. Didnt get it from me thats for sure.

Now about these costs and things I was readin a thread somewheere before and I think it was one of the mods (gary) that posted a reply to someones query and (I hope Im not mistaken here) they said that you put in for your costs eg; postage , time taken to get the bundle together , stuff like that, when the Judgement is in your favour and then it is up to the Judge what you claim for.

So looks like you and Iare near eough at the same place then with our claims. I believe there is quite a backlog around here for the Hali so would not surprise me if they put a defence in right at the last minute and then (I think ) arent they entitledto another 28 days or is it another 14 which would make it the 28 inclusive , 25th -9th then 10th -24th or thereabouts.

 

I was talking to a freind the other day and she was going for the NatWest she'd had a letter to offer just on half her claim and she sent a no thank you letter but said she would accept it in part but she would go to court if they did not pay her all the amount. They came back with , they dont do part payments and she had better take them to court then. She was getting worried but I told her they are just tryng to scare her into giving up and accepting less. I should imagine they will settle before it actually gets into court. Hope so for her sake anyhow.

 

Right well Im going to bounce around some more threads now and see what ill need for my bundle . Im sure someone had one that was over a hundred pages so quite a bit of work to be done.
