I am currently considering sending 1st Credit a letter requesting copies of the credit agreement for an outstanding unsecured debt of £4300 (originally with the Associates or Citi Financial) for which I am paying £20 pcm. I have a default registered for this account and would like to try and get it removed.

 

The likelyhood is that they will not be able to provide me with the agreement, but.............

 

If they can comply can they then start getting funny and demand the outstading amount in full even though I have been paying only £20 pcm.

 

Basically I dont want to open a can of worms, fail and then get a CCJ if you know what I mean.

even if they do supply documents, as long as you could prove to a court (if they took it that far) that you can only pay £20 a month, then the judge wouldnt ask you to pay more.

 

CCA them, see what comes back, if your sure they dont have it, jump at the chance!

 

plus are there any charges on this unsecured debt?

 

if there are, send the original creditor a SAR, then claim back the charges.

Hi, thanks for the reply - I dont think there are any charges on the debt - it was a while ago(defaulted in 2002).

 

Im not really sure what 1st Credit are like for having credit agreements.

 

I didnt want to bring my account to attention giving them reason to take me to court, thus a CCJ for the next 6 years when the Default will come off next year anyway.

 

If you upset these companies do they usually start legal action - where do I stand with the loan been unsecured?

 

Ive heard that 1st Credit are just bullies but im not sure how far to push them.

i would CCA them, and make your token payments just now.

 

send the CCA recorded delivery with your £1 postal order for the request

 

if you need a CCA template, just ask, im more than happy to help.

 

if after 12 working days (from when they sign for the recorded letter) they havent provided you with the documents, you can LEGALLY stop payments until they satifsy the legal request (the cca)

I am presently striving to organise my personal information and can find no reference to the alleged debt and/or agreement on you appear to have been assigned to collect.

 

Therefore, please supply me with a true copy of the original agreement.

 

You will appreciate that this is my right and your legal obligation under the legislation contained within section 77 (1) and section 78 (1) of the Consumer Credit Act 1974.

 

I also understand that it is your obligation to provide me with a statement of account and I look forward to receiving that as well.

 

Please also supply a signed true copy of the deed of assignment of the above referenced agreement if applicable.

 

Again, this is you will appreciate a statutory obligation, whether you are the original creditor or not, under section 189 of the Consumer Credit Act 1974.

 

Please note i have enclosed the statutory £1 fee for this request, this fee must NOT be offset against any alleged debt and must be for the purpose stated.

the £1 fee

 

use a postal order as if you send a cheque they COULD (not saying they would) get your signature off of it

 

and never sign these letters with your real signature either!

they cant ask for the full amount, you go back to what you were paying before, but dont be scared of these people, for instance

 

THEM - YOU MUST PAY US £100 A MONTH

 

YOU - I CANT AFFORD THAT

 

THEM - WE DONT CARE WE WILL TAKE YOU TO COURT

 

YOU - OK THEN SEE YOU IN COURT, AND ILL BRING A COPY OF MY INCOME AND EXPENDITURE SHEET, BECAUSE I CAN ONLY AFFORD £X PER MONTH AND THE JUDGE WILL SEE THAT AND WILL NOT FORCE ME TO PAY MORE THAN I CAN AFFORD

 

 

THEM - BEEEEEEEEEEEEEEEEEEEEEEEEEEEEEP (HUNG UP)

 

 

 

thats the typical scenario with these guys now, you tell them to take you to court, you tell them youll bring your income/expenditure, and you tell them a judge wouldnt look for more than you could afford to pay
