I am currently claiming £763.92 plus £80 court cost from RBS. They have just sent me a offer of £539.00 to be paid direct into my bank account. The bank account was closed 3 years ago. I would like to accept the £539.00 as a part payment.

Has anyone got a template letter that I can copy, as I don't want to mess up my claim at this late stage. I would also like them to send me a cheque is this possible.

I have issued a court claim and the 28 days are up on the 26th April.

Unfortunately, people do.

 

The reason for making the offer is calling your bluff. Telling you you aren't entitled to your money back but they'll give you SOME money just to shut you up. The logic behind it is they've saved themselves some money.

 

Not everyone is registered to CAG so they don't necessarily have the advice that you have use of so there is a very good chance a lot of people accept these part settlements. In fact I'd go as far as too say there are a lot of people that are registered to CAG who accept partial settlements too!!

Fair point Taff.

 

I suppose that if the bank makes someone an offer on the back of the LBA and it is a reasonable percentage of the sum claimed then maybe I can see why it would be accepted.

 

A lot of it is the fear of the unknown-what do I do if the bank refuses to pay etc.

 

Thats why this site is invaluable-it takes away the fear factor.
