      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi, sorry hun, didn't realise anyone had posted on my thread recently, was watching PM's from you but not taken much notice of my thread as nothing going on at mo. This is the longest wait of my life, no kidding.

 

Don't think my N244 & Gary's application for me has gone in front of judge yet, will try again weds like they told me to, but I did phone friday and yesterday (they are probably getting a bit weary of me!).

 

Getting a bit worried now, as I'm not normally the luckiest in situations like this, but am confident in Gary! (no pressure!:D ).

 

If I do hear soon - you'll know about it!!!! (either way!).

Yes, probably about 1pm, but I expect it will still be no news. They are behind on bank claims, and must be getting fed up with me ringing! Don't they say 'no news is good news'. - I really hope so, can't take this much longer!

Hi, no news I'm afraid. She took my number so the guy I spoke to last week can check for anything and call me back, but it doesn't look like a judge has seen it yet.

 

Oh well, here's the run down of my claim to give you something to read for now!

 

Jan 11th - S.A.R - (Subject Access Request) request sent.

Mar 6th - 14 days to pay letter sent.

Mar 15th - Phoned Lloyds, got a reference number, never heard again!

Mar 23rd - No reply to 14 days to pay letter.

Mar 28th - MCOL filed.

Mar 31st - Finally, Lloyds standard 'no' letter.

April 3rd - Court claim deemed served on lloyds

April 12th - Lloyds acknowledge claim.

Bit fuzzy here - Lloyds put defence in anyway!

Jun 13th - Court order for disclosure - we all thought the end was near!

Lloyds did not comply of course.

Jun 26th - my court bundle duly submitted.

Jul 11th - Non compliance letter 1 sent to lloyds.

Jul 18th - non compliance letter 2 sent to lloyds.

Aug 1st - Back off hol to find Lloyds had snuck in an 'ex party order, asking for re-allocation to fast track.(Should have won by default at this point but their order was granted!!!!)

Aug 6th - With Gary's help, N244 & application for set aside to order or strike out put in to court.

Aug 15th - Is there a song about still waiting?.....

 

And now it all comes down to whether the judge agrees with me, or lets Lloyds order stand. (Which if it does, they will treat it like a new case and ask for a stay apparantly!).

 

:eek: Watch this space eh?

Seriously, this OFT business is enough to drive anyone up the bloomin wall. It has been ordered that my case be stayed till 29th Feb 2008 :mad:

 

I've just checked & there IS a 29th Feb next year, I should be grateful for small mercies I suppose :rolleyes:

Can you imagine, 29th feb in four years time or something!!!! You wouldn't be a happy bunny then eh?

 

This stay business is not good, mine could go same way but if it does then there is something wrong with my court after all I've been through so far!

 

Will phone again after lunch today, but am still waiting on a judge seeing my application from the 6th. (Gary's brilliant writings in an above post).

 

Take it you are opposing the stay? I will go take a look at your thread, think I already have it subscribed actually. I just don't have a good memory!

Me again, you'll be thinking I like the sound of my own voice here!

 

News from court, - if I'd phoned the right department 5 days ago I might have got further.... but, got through to listings today, and the very nice lady is putting my case to the judge this afternoon, so I may hear back by sometime later tomorrow, either way. fingers crossed!

Hi guys, thanks all, I just tried to chill last night and not think about things, sick to the stomach this morning that Lloyds will still get their way, but will have to see if the court phone me today, might not be til monday though:eek: , don't know if she will get it back from judge that quickly.

 

McIavelli, like I said, more like bagpuss than kitty, think I might cause a few accidents (and not in a good way), if I rode round like that! You made me laugh though!

Hi all,

 

Phoned the court, an order is in the post apparantly. The woman was in a hurry, but said the judge has listed my application for set aside against Lloyds re-allocation to fast track, for the same day as the original hearing was, (7th Sept), which was changed to the case management hearing on Lloyds 'ex party application'. (does that make sense?).

 

Not sure this is good news, as I think Lloyds will definitely be there to try and uphold their allocation to fast track, or get me thrown out.

 

Will post the order as soon as it comes - but any thoughts anyone - I think I thought it wouldn't get this far or this bad, like most of you did for me!
