They might just treat that as a seperate request and start the 40 days all over again.

Why not get into them for the past 6 years and then start another claim for earlier years?

in a rut here-if i take them back to march 2002 i can claim £4982 which sits nicely in the small claims bracket-if i go to the full 6 years it will probably be about £6000

Then what I would do is have one claim from March 2002 and send SAR for banking history past 6 years. Use this info for second claim.

I would not let the fact that you claim exceeds the £5K threshold stop you from claim higher. You can still ask for it to be allocated to the small claims track, sometimes judges will.

 

The fast track has one distinct advantage, i.e. disclosure, in my view providing you prepare well, the fast track is not be feared.

wondered-my hubby has aloan in his name but i have written authorisation on the account-would i be able to claim on his behalf

HI-getting ready to prepare N1-just a couple of questions-going for 8% stat interest on a claim of £4987.50.if I add interest on in the value column it gives me roughly-£4987.50 +approx £700 in stat interest + court fee.

confused-do i have to pay £250 court fee because the claim comes to £5700 inc interest or do i just base it on £4987.50 and pay £120 court fee?

hi guido-i have had other charges added to my account since i started which takes it to roughly £5300 + stat interest-would you advise that i carry on and stick with the £4987.50 claim & chase the rest later-or-go for the whole lot now?

 

it just bothers me that i may go over the small claims route-not really read up on larger claims

Personally I would go for the whole lot, but you must make yourself aware of the risks with fast track.

 

The £5K threshold is not a hard and fast rule and some judges are confused about whether to include interest or not (when they should exclude interest with track allocation). So even if you go with your present claim, i.e. £4,987.50 you could still be allocated to the fast track.

 

Once the defence is filed you can try and influence the track allocation in the AQ or if the AQ is dispensed with by writing to the court.

hi-went to court yesterday to collect info on fat track-just in- case (Lloyds 14 days after lba is 13th june).

 

claim is £4987.50 but have gathered another £450 or so since receiving further charges e.t.c.really helpful lady in court office told me that anything up to around £8000 could easily be small claims and that aq are not usually sent because of amount going through-in a quandry -worried about the thought of fast-track-but it would mean not having to do it twice-mmmmmmmmm

Don't let the issue of Fast Track worry you, from what I've seen this route can be very benificial and usually means a faster result.

panic-i've got £6200 to claim after adding 8%when i file-its going to cost me £250 in court fees-which is why i'm waiting til payday on monday.lol

 

still apprehensive-wondering whether to cut it so it comes to less than £5000so a-i have only £150 in court fees and b-it will almost def go through small claims.

still not filed-think i moght go for £5000 for now-lots happened though-scm took over my account-upped my overdraft limit and set up a payment plan-£50 per month to reduce it starting july 30th.

 

now they have withdrawn the facility days after increasing it so if i get a partial settlement it will just reduce the overdraft!

 

am claiming the £5000 but the o/d is now £2500 so if i should get the usual £750 i wont see any of it.

 

theyve also frozen my savings account which has £90 in it which is showing as available-can they do this-i'm sure its retaliation.

 

are they obliged to pay settlements into the current account???????

[problem] can't do that they are solicitors not bankers (although there is a similarity :D ). Are you sure it wasn't LTSB collections center in Brighton that came up with the payment plan?

right-spoken with [problem]-it was them-theyve now extended my o/d to cover charges next month, unblocked my savings account, and set a payment plan.

 

to thank them, i've just completed my ni-for £6500.lol-it will be posted to my local court tomorrow.

was meaning to pop my n1 to court today but got sidetracked-all to a good cause though-settled welcome finance ppi and charges claim over the phone!!!!!!

 

lo and behold got a letter from andover saying it is now 4 weeks since they last wrote ,they thank me for being patient and hope to come to an arrangement soon .
