Hi all, this is my first post and I am looking for some advice.

 

I basically tried to cliam back charges to my account in September last year: did all the right things, got my bank statements,sent them the first letter etc...and all I got back was this reply which is probably standard anyway but put me off from pursuing it further: :(

"

Dear The-Miser,

Account xxxxxxx

Sort Codexxxxxx

Thank you for our letter of 1st October 2006 . I appologise for any dissatisfaction caused by the application of charges to your account.

We beleive that our charges are fair,reasonable and transparent.We consider that the amounts debited to your account have been applied strictly in accordance with your agreement with us and our published tariff, which we are satisfied complies with all aplicable laws and regulations.We are also comitted to ensuring the transparency of the information the we give to our customers about the operation of our products.

Against that background, we must differ to the views expressed in your letter.Accordingly the gharges thta have been aplied to your account must stand.

However, thank you for taking the trouble to writte.

Obviously, this could be just to discourae me to pursue this any further, but if anyone has any idea on how to get further in this matter I would be very gratefull...Obviously there hase been quite a gap in me picking this up again but I could always make a new claim...the have off course applid more charges to my account since...!!!!

18/04/07 1st letter sent (again)

19/04/07 letter received by Stuart Higley

25/04/07 Usual blabla letter from NatWest "investigating and so on and so forth" received.

08/05/07 LBA sent

09/05/07 LBA received by Natwest

25/05/07 Claimed online by MCOL

Claim served on the 4th of June

Acknowledgment of service received 18th of June

Cobbets defense and Part 18 request received 05 July

Notice of Transfer of Proceedings received 06 July

19/07/07 Allocated to small claims track, refer back after 21 days.

Do not let Nasty Vest put you off claiming.

 

Recalc the charges and send a new schedule to NW requesting that they repay and give them 14 days to respond.

 

They will probably give the same rubbish reply as before and when they do you can then issue the claim via MCOL and at this stage you can factor in the 8% interest.

 

Dont be put off by what NW say-the money is yours.

Hello, and welcome.

 

Yes, you are correct, this is a bog standard letter, designed to put you off your claim.

 

As you said, you could start a new claim, but all you are really doing is just taking the first step again, and including all the new charges.

 

There are various forums here that relate to different banks/financial institutions and other topics, so find the one that relates to your bank(s) and have a look in there.

 

Have a very long look at the FAQ's, and remember to refer back to them from time to time as a refresher.

 

As you get more fmiliar with the site and the process, it all gets a lot easier, and there is always plenty of help and support, so you'll never be alone.

 

It can be daunting, and they wont stop sending letters to put you off, but this time you will be prepared, and mostly you'll have a very good idea of what they will do next before they have even done it.

 

This is not an overnight job, but this is a well trodden path now, and a bit of perseverance, a bit of studying (the FAQ's again:), they really are important), loads of support, with just a bit of patience thrown in for good measure and you'll be fine.
