      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi everyone

I have just discoverd that Barclays Bank has been charging me since at least the past two years £11.50 for something called Additons Accounts.

Aparently this is a premiun account that I have never asked for but to be opened they just need a verbal agreement (which I never gave) and is absolutely ilegal as is a case of misseling. I did not ask for the service but they are charging me.

Anyone knows what are the steps to folow first to cancel this kind of account and to get the money back for all these months charging me this service?

Also there is any way that I can asked then to check since when they decided to open this bank account for me?

Hello

 

This was shown in the BBC Whistleblower program of about a month ago. If you didn't see it, then try the BBC website to view a copy, as you will be suprised what Barclays do to your account. They just add this 'facility' without any authority, or even asking customers in some branches.

 

I would try looking at the program, then going into your branch and demanding they refund the lot, plus interest. They may, after the bad publicity lately, agree, if not, then commence a claim against them.

Hi Louis for your early reply.

The truth is that i saw the program and i was shocked with their practices. I had a very bad experience in the past with barclays regarding some international bank account service that i never asked for and since then i read all my bank statements one by one.

Unfortunatley my partner doesn't do the same and the other day i asked her to have a look to her bank statements (after watching the bbc program) and with great horror we discover that she has been charge £11.50 since at least two years.

I wonder if I can ask the bank for very old statement like 5 or 6 yearas ago. I guess so as the more i am reading in this forums the more that i discover but i presume that I will need to pay a fee for that £5-10 for 5 years statements.

I am a bit lost about what are the steps to follow once I discovered since when they have charge her for this additions. Should we go to the bank, write a letter, ring customer services?

Any advice any experience will be very very welcome...I keep reading and learning....

My handicap is tha english is not my first language and my writing is not really good..

firstly, you can get your statements going back 6 years (some people have got them from loger but that isn't standard). you need to send this letter

then when you get them, add up all the 'charges' that have been added.

I understand you language difficulties, but it is important that you understand what you are doing, so if you have a close friend that can help you it would be useful.

Thanks for the advice....I believe that I am fully aware of what I am doing...is just that I get a bit scared of writing a complaint.

I will have a look to these links and do my homework and get well prepared for the next visit to my local barclays bank
