I entered Judgement against HSBC for £2420.29 at Bow County Court on 12th April 2007, Case No. 7BO001148. The Court received the Request for Judgement on 12th April by fax. The Defendant was required to submit a defence by 10th April 2007 and a member of the Court staff confirmed on the morning of 12th that nothing had been filed and I could enter Judgement. I also sent the original of the request to the Court by first class post the same day.

 

This morning I received what I consider to be a very strange email from Allison Forecast who claims to be from the Court.

 

From: Forecast, Allison

To: 'pxxxxxxxx.co.uk'

Sent: Monday, April 16, 2007 11:40 AM

Subject: Request for judgment

 

 

I have received your request for judgment in the matter between yourself -v- HSBC.

Due to an administration error the incorrect form was sent out to you.

I am sending the correct form to you by first class post this evening, sorry for any inconvenience caused to you.

Please can you return the form marked for my attention

I find this email very strange. A request to enter judgement could be made by letter. It is not dependent on any particular form. The meaning of my request is clear and I do not see that it can be reasonably denied. I am entitled to Judgement as the Defendant was required to submit a defence by 10th April and did not do so. Indeed, as it is a default judgement I believe that it has already been granted and I wish to take immediate steps today to enforce it.

 

I have tried ringing your telephone number but it rings unanswered.

 

Please contact me immediately on either of the mobile numbers below.

 

 

To be blunt I have the feeling that somebody is pulling strings to give HSBC more time.

 

Any comments/suggestions/advice??
