I'm quite a long way own the road of sueing Barclays. Last week I submitted my Court Bundle (list of charges claimed, statements and Statement of evidence). Barclays have until the 16th May to submit their evidence to the court & me. One of the items that the court have requested is evidence to justify their charges - I'm imagining/hoping that they won't/can't do this. If they fail to do so can I apply to the court to have their defence struck out or will the Court do this automatically?

read the other threads I suggest

 

I think they usually fail to submite a defence and you get default judgenment, they might enter a set aside and get more time and then settle in full a day before the court date

 

there's a lady at Barclays to call a few days before who gets you paid

 

something like that, these things are very ritual so read some of the other Barclays threads for tips

if you'd seen my car you'd know remoulds is all I go for, when I can't get part worn

 

do you think they really do check every claim line by line?

 

I think they might check the odd one but otherwise just **** about until the last minute and then pay

 

I need some tyres too, I could conceal the charge under something grand but meaningless

Not sure about checking each claim but if I was you I would make sure that what you are claiming for can be justified should they decide to query it

dont forget they will have the facility on their system that will allow them to view charges only on the screen, this way they will only have to compare one with the other,

 

but if you want decent part worn remoulds and the court case is looming..

add costs for loss of earnings [CPR27.14]

True, not sure I'd fancy comparing line by line with an excel print out though

 

granted the sum should tally

 

loss of earnings is the time spent on the claim, letters and so on?

 

that goes in at the MCOL/N1 stage doesn't it? I fully intend to claim for that is so

is costs claimed for loss of earning for the day of the trial.

 

Because I work on a monthly rota, I have a deadline to get MY shift covered, they missed this so I was able to claim the LOE

Thanks for the advice so far. Could you (Micky the Hippo & Kimmy01) please elaborate on what you have said so far:

 

Micky the Hippo - who is the lady I should call at Barclays who will get me paid and is that a few days before their submission date (16th May) or before the court date at the begining of June?

 

Kimm01 says that I should ring litigation 2 weeks before Barclays are due to submit thie bundle

check any of the WON threads and you'll see the details you need in almost all of them, it's a very formal ritual towards the end

 

not being difficult, I don't know without checking and it's a really good idea for you to skim a few threads of those that have gone before you

 

as I recall, a week or two before the actual court date, krsytal something
