I recently sent of the latter asking for a copy of an original credit agreement from a company who claim that I owe them some money, I received a letter back from them saying that they are in the process of finding it but it may take longer than the twelve days that was stated in my letter. Can they do that or do they have to stick with the twelve days? I sent the £1.00 fee.

It is not a criminal offence after 12 days - the 'agreement' is unenforceable. 30 days after the 12 days is when the creditor's default becomes a criminal offence.

Nationwide - Prelim sent 02/07 - MCOL filed 04/07 CHARGES SETTLED IN FULL!!

Woolwich- Prelim sent 04/07 - Offered 90% - 06/07 accepted

MBNA - Prelim sent 02/07 - CCA request sent 03/07 - CCA reply (illegible + no T&Cs) - DCA sent packing - Restons now trying - gone quiet

Citicard - Prelim sent 02/07 - CCA request sent 04/07 - replied 04/07 No contract & not enforcing!- passed to 1st Credit- gone quiet

Egg - Prelim sent 02/08 - 3 letters - full offer 03/08 SETTLED IN FULL!!

No, that is incorrect.

 

After 12 WORKING DAYS they are "in default", and you can legally stop payments until such time as the agreement is supplied.

 

After a further period of ONE CALENDAR MONTH they will have committed an offence under the CCA.

apologies - i misunderstood - can you answer my query - i requested my signed agreement and received a letter saying they did not have it so therefore it is not enforceable through the courts but unless i am disputing i owe it then the default will remain ? not sure where to go from here?
