I had the misfortune of having to organise an I.V.A. due to bank charges, redundancy etc. Does anyone know if I successfully reclaim these charges can the R.B.S. take the money back for the debt that was part of the IVA (Credit Card Debt):oops:

A couple of questions

1. was the whole amount of your RBS debt included in your IVA

2. When you say IVA do you mean Trust Deed (in scotland) and

3. Was it protected

4. Is it still in force (how long to go) or has it been discharged

 

I can pre-empt some answers.

If the Trust deed is still in force then the debt is now in trust (and hopefully protected) so no the bank cannot keep it to clear the debt, however your trustee will almost certainly want a substantial amount of any settlement you get from the bank. Unless you didn't declare it but that may not be to wise as the bank may write to your trustee. The bank may negiotate with you/your trustee to reduce the debt by the amount you claim back. Which is probably not what you want as this would just mean more money for any other creditors. You could talk to your trustee about this.

 

If this is not a Trust Deed and it's just an IVA then I'm pretty sure the bank would just keep the money and reduce your debt which may reduce your overall payment to them.

 

It may be best to wait for you IVA/Deed to finish if that's not to far away before reclaiming.
