Good afternoon Daz,

 

you amaze me, you are incredible, you are a knowledge of everything.

 

You should be running for President, I went on the site you gave me joined another forum about orlando florida and received loads of advise, all saying not to worry weather is great, sometimes rains but what the hell!!

 

So off i go, booking on Wednesday once the courts give me the nod to take foster child, so 3 weeks and counting.

 

Thanks, when i get back i am going to start claiming for beyond 6 yrs. I am sure i have loads, as that is when partner left me and i had to adjust from going from unlimited funds (he was rich) to council house and little income. But hey here i am and doing very well.

 

You never know if i get enough i may be able to continue with my business ideas. Thanks again Daz

Hi Caz, i'm sure you'll enjoy your break, and then it's back to claiming beyond 6y'rs, well at least you'll be all ready to go then so look out Bs, i'm hopeing to start my son's "beyond claim" tomorrow, well send the sar off anyway then wait and see what charges he has had taken off him prior to 2001, then we'll take it from there. anyway have a good break, see you when you get back.

incorporate a quote into the pre lim letter saying please do not reply with:

Won't work. I sent B/card my LBA specifically telling them not to bother offering me the difference between £12 and £20, as I knew it wasn't legally valid, etc... and they still did. :rolleyes:

 

Even worse, they then didn't wait for my reply and just refunded the difference.... to a closed credit card account.

 

They get better and better, don't they? :-D

Right, everyone who knows me on here, already knows I can be a little bit cheeky.

In true form I have just sent the following email to B's

 

I was just contacting you to see what progress you have made concerning my recent communication with Barclays as i have had no repsonse to my letter or emails sent.

 

May I remind you that you have until 8th June to comply with my request or I will have to take further action.

 

Alternatively, if you would like to put the proposal to the Litigation Dept to consider the following

 

I reclaimed the amount of "£2,108 for the period between 2001 and 2007

Therefore, assuming the same average of charges applied for 1993 to 2001

Would estimate a claim for £2,810.

If you are willing to settle with this amount, the matter can be resolved.

 

Realistically I dont expect a result, but you never know these days, if you dont push, you dont move.

NatWest Claimed £1,639. Accepted £1,344.

Natwest Paid me again as GOGW £1,656. Yes they can have it back if they say please.

Barclays 1 Claimed £1,260. Won by default. Paid in full

Barclays 2 Claimed £2,378. Won by default. Paid in full

Birmingham Midshires. Claimed £2,122. Accepted £2,075.

glad to see you are pushing forward in your 'beyond claim' you truly are an inspiration to many on this site.

 

Keep going forward, you will make them see sense in the long run and your actions will certainly keep otheres on the right track.

Great email Daz,

 

It sounds like a good idea, I would dread to think how much my back dated amount of charges beyond 6yrs, i would expect the same amount at least.

 

Keep going, I am considering sending another SAR's now before I go on holiday and seee what happens.

 

I am keeping a very close eye on your actions

In principal, I think Barclays will not let you off easy, since it will have devastating implications for them. Imagine, if they paid out, then I am sure everyone who has tried to get back past years will also want everything back, this would be a large amount, maybe too large for the banks even. Hence they might actually have to bite the bullet and fight it in court. Of course if you win......:)

 

I will also do this once my first 6 year claim has been resolved.

 

One point of note,in your letter you sent as a reminder to give back your statements, is it normal to mention that you will be claiming back, they already know of course, but should you not play it a little safer paper wise. If it goes to court, you are already asking for money despite only quoting data protection in the first letter. I suppose this is a very new avenue and we will just have to see the best approach to this!

 

There is sure to be a test case somewhere, esp if we all go back in time!! lol

letter dated 4th June.

2 pages, so heres the highlights of it:

.....personal apologies for inconvenience & frustration.......Barclays aim to deliver a high std of service....on this occasion, we have failed.[YOU DONT SAY!]

explaination.......when you requested your 6yrs backdated.......[WHAT!]..our Central Telephony Advisor......[FUNNY IT WAS A WRITTEN REQUEST]...was not aware there was a delay.......high volumes of requests.....

We are processing requests in order they are received.......

i will forward your request which will be dealt with within 28days....[THAT WILL BE 81 DAYS THEN!!]

....sorry blah blah blah.....

I hope ive answered all your concerns.......complaint file open for 8wks and then if no reply will be closed.....

Our aim is to resolve the matter internally......if unable you may be able to ask the FOS to review your complaint....[GEE THANKS!!!]..i hope we can resolve matters before you take this step...[ERM DONT THINK THATS GOING TO HAPPEN]....

We take complaints seriously..[PMSL]...would you complete a short survey......by doing this you will help improve the quality of service...[OMG ROFL]...

Once again sorry........

One recommendation to Barclays....IMPROVE YOUR INTERNAL COMMUNICATIONS!!!!!!!

Why do I get the feeling that even if I DID wait 28 days, I'd still be where I am today?????
