    • Hello, I hope you're all well, I just wanted some advise on my debt situation. So currently my debt is a total of £17,000, 7k to Amex and 10k to TSB as a loan, now I have never missed a payment and I have always been on time but I have had some personal circumstances that mean I need my money and I cannot afford to pay these loans off for the time being. I'd need around 4/5 months and then ill be able to start making the payment again, I've been reading on the forum and I have seen many options but I'd like to know what the best option for me is. I don't want and IVA or DMP and nor do I want to go bankrupt. I've read about defaulting and minimum payments etc, Say if I didn't pay anything for 4 months or maybe paid bare minimum then once the 4 months is over I make up for the payments? Sorry If I sound stupid but I am just trying to figure out the best option before doing something stupid and going for an option that is more feasible. Thanks
    • For NI it depends on how you pay. Pension Contributions come out via your gross pay as a deduction = You pay NI. Pension contributions come out via salary sacrifice = You don't pay NI. You wouldn't pay income tax on it either way.  
    • Hi Isn't the pension contributions tax exempt - so take Gross - pension = taxable income?? Obviously the Tax Codes and Thresholds will play a part in the calcs as well G
    • Yea the counter is open 10-4 apparently but in reality if you go to the court and go to secuirty just refuse to go away and ask them to call the civil team they will eventually and they'll take the payment  
    • Update My insurance declined the claim since lung cancer was a 'pre-existing' condition at the time of booking Will try and ask BA to reconsider, otherwise I will lose several hundred pounds Probate (or rather the equivalent here in Malta) is completed and took 2 weeks from receiving the official death certificate Have now sent off all the necessary closure forms to Pension, Insurance, UK Bank, etc. Just need to visit the embassy to have her passport cancelled G

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I'm so angry I could scream, they have already made me swear today !!

 

With only a couple of days left before the 40 day period to comply with my dpa request they have returned the cheque sent to them saying that there was no account number on the back of it, the account number was printed on the letter to which the cheque was attatched, surely that should have been sufficient ? I appreciate not putting the account number on the back of the cheque was a boo boo by me but surely they are just taking the p*** ?? and playing for time.

 

What do I do now, return the cheque to them with the account number written on the back I know but do I then have to give them another 40 days to comply or just carry on with planned dates from initial request ?? I could kick myself but I still think they're being pathetic and know exactly what the account number it applied to was.

Looks like they're using any excuse to delay things.

 

It might be worth going to the IC for advice, Its blatantly obvious that they're deliberatly stalling.

 

Try not to get too wound up though. Its obvious that they're rattled by whats happening, and I'm sure they know you have a rightful claim.

That is not a valid reason for not providing details under the DPA.

Thank you for your replies turt77 & jonni2bad,

 

I think I'll send them the cheque with a covering letter and include a copy of my initial letter to them first thing Tuesday morning by special delivery, then if they don't respond i'll send the non compliance letter to them and hope that pushes them into action, if not then i'll push forward and file a complaint against them for non compliance, they've really bugged me with this, I wouldn't mind but I know it can't be a fortune I'm claiming back and is a drop in a very large ocean to them, unless it's more than I think and i've got them scared lol.

Hi,

 

I don't think i've started a thread regarding this yet, so I thought I better had since i'm having a few problems with the YB.

 

So far I've sent them a DPA request, got no reponse, I've received my statement today and the £10 I sent them for the DPA request was added to my account on 8th June as a payment into my account ? is that right ?

 

At least I know they've received my request but it doesn't look like they're doing anything about it. What do I do now ?

Am I right in assuming that you sent the template letter from the library, which specifically states that you are enclosing £10 for the DPA request? It looks as if they are deliberately stalling, in the hope that it'll put you off claiming - don't let it!! Personally, I'd carry on with your deadline, but specify in your prelim request for refund letter that you are claiming for an estimated figure due to them providing the information you requested. Make sure you over-estimate slightly though [they'll soon correct you if you are wrong!].

It looks as if they are deliberately stalling, in the hope that it'll put you off claiming - don't let it!! I did use the template letter from here. I'm a bit concerned about continuing without my statements tho, I really have absolutely no idea what the amount could be. I foolishly don't keep all my statements and after a year or so, I shread them. and I don't have online banking with them :(

 

I've banked with them for about 20 years so I'd be applying for the whole 6 years of charges and just really wouldn't know where to start.

 

I'm wondering if it might be an idea to call them Monday morning and ask what they're playing at.

 

I'm usually too laid back for my own good but all this and getting messed about with other banks too is getting on my wick now and I'm feeling pushed to the edge and ready for all out war if needs be.

 

I just don't want to cock things up :/

Personally, I'd probably think twice about contacting them by phone, and try to keep everything to written correspondence. However, if anyone disagrees, please feel free to correct me :D

sorry I don't think I made myself very clear lol. I think your right, I'll have time to calm down over the weekend then set out my DPA non-compliance letter and post that off to them.

How long ago was it since you sent off you request for your statements? I'm asking cos we didn't hear a dicky bird until just before the 40 day limit, for some reason we didn't seem to qualify for one of their nice letters saying "we're dealing with your request".

I see now how long ago it was & they are definitely playing the stalling game. Could the mighty, not scared of anything & always so bl**dy right yorkshire bank finally be getting rattled by all this? Certainly looks like it to me :)
