Hi all, sorry for not keeping everyone informed on my case for a good while now but wedding,work,bad hair days and everything else that been keeping me busy has kept me away.

 

Here goes, last time I posted, (see tweedtech v hbos) I had had no response so downloaded the paperwork to make a claim, printed it out and thats as far as I got.

 

Got a letter about 3 weeks ago saying they are still looking into my complaint and would hear back no later than 17 April, blah,blah,blah, Started to fill in my court papers only to get called out to another job.

 

Anyway arrived home today to be met with a letter from em offering me the full amount of my claim (less interest) in full and final settlement and without admitting liability as a good will gesture.

 

I hadn't even finished filling in my court papers and they have paid out, on the backfoot me thinks, everyone hang in there!! Will be sending in the donation once the money arrives, thanks to all who has helped me along the way, you're all stars!!

 

Only one more thing, as accepting this offer (claim from 2002 to july 2006) do you think I can claim the rest from then till now?? or am I being a little cheeky?? anyone any opinions.

BoS tried to say that in accepting the previous cheque I had "accepted full and final payment" for all claims. They also said that all future charges would be acceptable to me.

 

The letter they sent out to me had NO mention of "full and final" acceptance.

 

And anyhow any future charges would still be unlawfull as they are still charging ridiculous sums that they cannot justify.

 

There is a letter on here about how to respond to this letter. I would say something along the lines of you "not accepting this offer as full and final payment" and send it recorded.

 

I would say any further unlawful charges they hit you with would be re-claimable.

I also had an offer from halifax and I sent them my own letter back saying would accept but no conditions,now they wont pay the money out as they want their own acceptance letter back!I too have had more charges since i started this.I'm thinking of going to FOS now.

Prelim Sent -27/02/07....

Response Letter rec'd -13/03/07....

LBA Sent -15/03/07...

Court claim due-30/03/07

Offer received(10p/cent short)-declined for full amount-28/03/07

Success FULL 6yr amount offered-29/03/07:D

........not yet received because they want me to accept conditions!!:(
