Well here we go, further to my previous posts, have now recieved a court date! I think ! ?

 

MCOL last stated, 30/03/07, I am unable to take any further action on line and the proceedings will be transferred to the appropiate court for continuation.

 

Recieved today 2 letters from Poole County Court, N24 Notice of Hearing and N24 General Form of Judgement or Order,as follows :-

 

1) This case is listed for hearing on Friday 29th June 2007 at 10:00am.

2) It will be listed with all other outstanding claims for refund of bank charges etc.

3) The parties shall file and serve witness statements with copies of all relevant documents annexed by 4.00pm on 15th june 2007.

 

I was expecting an AQ N149/N150 from the court first and this has caught me on the hop a little bit. Just need have a couple queeries before I crack on!

 

Item 2, is this the norm to bundle similar claims together ?

 

Item 3, I assume that this is the Court Bundle that is required ?

 

Can SC & M request a stay at this stage, if so how can I tackle it ?

 

Is this the big one, or a prelimary hearing do you think ?

Case so far

 

8th Feb 2007 - 1st letter sent.

22nd Feb 2007- Lloyds standard reply.

23rd Feb 2007- LBS sent. recorded delivery.

1st Mar 2007 - Lloyds letter, stating request been sent to Andover.

4th March 2007- Letter to Andover informing them of impending action with MCOL.

7th March 2007- MCOL claim raised, served on 12th March.

26th March 2007 - SC & M acknowldeged claim.

27th March 2007- SC & M stated a defence.

12th April 2007 - Court date recieved, for 29th June 2007.

Hi Big Man,

 

Item 2: I think they do this because they know that the banks tend to settle at the last minute, so it saves having lots of spread out hearings cancelled.

Item 3: Yes that's the court bundle. Check out GaryH's thread here for lots of useful info.

 

Not sure about the stay but I'd be surprised now that you've got a hearing date if they could do this - but it's not an area I'm majorly familiar with. This is probably the standard hearin as I believe they say when it's a preliminary hearing.

Was wondering if it would be worth firing off a letter to court straight away, using Gary,s format for preventing a stay, or will they just chuck it back at me ? :D
