    • Our price is the same all day, but varies day to day. Yes there's a risk of high prices but it has never gone above SVR any time since I signed up. Last 30 days average 17.67p/kWh, max 20.67 and lowest was 11.83.  It saved just under £300 during 2023.  
    • It you had E7 in the past but have converted to single rate then the meter will still hold the last recorded Night readings. This introduces scope for error when manually reading. If the meter has only ever been used on single rate then there's only one figure that can be taken. For example ours shows "Rate 1" reading and a "Total import" reading, but they both give the sme figure. If it has ever been on E7 the total will be higher, including the retained night reading.
    • okay, perfect and thank you so much for the help once again. so firstly i am going to initiate the breathing space, during this time it's likely ill receive a default. when i receive the default are you aware of how long it will take for me to know whether the OC have sold it off to DCAs? Once it's with the DCAs i do not need to worry as they cannot issue a CCJ only the OCs can Even if i decide to come an arrangement with the DCAs no point as the default will remain for 6 years paid or not paid I should only consider repayment if the OC still won the debt and then issue a CCJ? Just to confirm the default will not be seen after 6 years? No one can tell I had one then after 6 years ill be all good?
    • I'm not sure we were on standard tariffs - I've uploaded as many proofs as I can for the ombudsman - ovo called last night uping the compensation to 100 from 50 pounds for the slip in customer service however they won't acknowledge the the problem them not acknowledging a fault has caused nor are they willing to remedy anything as they won't accept the meter or formula was wrong.   I'd appreciate more details on the economy 7 approach and I'll update the ombudsman with any information you can share.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hey there,

 

Thought id 'come in and say hi'!! The peeps in the chat room said this was the best place to start, I've just completed my MCOL form and sent this off after the 2 quite frankly poor exuses from Nationwide about their so called 'fair' chrarges.

 

Trying to reclaim: £1159.00 + £140.14 (Interest)

 

I understand i have to wait 5 days now, then a possibe 14? or maybe a possible 28? But read that if they do defend then i might have to actually defend my claim? arrgh! what's likely to happen next? I've read alot of the threads and understand that Nationwide usually drag their feet to a court date?? should i be worried!?

Tick Tock.... just had confirmation that MCOL have accepted my request and Nationwide now has 14 days to reply.

 

Quite a scary situation...do i need to send the copies of my charges to the courts now or does this depend on what Nationwide do in the next 14 days?

Thanks for that Hod, I've just almost crapped myself....but then read another load of threads, which eased my mind no end! So i understand they have 14 days to respond from the date that MCOL accept my request, does this mean I have 14 days to collate all the information or the 28?

 

I've got it all and obviously want to make sure i don't rush anything as to ensure i get it set out as proffesionally and indepth as possible. Does the bundle have to go to the court and the Banks solicitor as soon as the first 14 day period has expired? if so how do i get the relevant names and addresses as all i know from MCOL is that they are pursuing the claim.

I've just copied the template for the court managers attention - with the claim number and a schedule of charges to attach to the claim, is this correct.

Hi Ozz

 

First of all it might be ebst if you start a thread in the relevant bank section for your claim, this area is meant for newbies!!

 

Also I see you have started you court claim. Let me give you a run down of the process from now:

 

1. The bank will receive your claim and they have 14 days to write to the court and say they will defend. If this happens see section 3.

2. If they dop not respond within the 14 days you can either give them extra time or request judgement for not responding to the court papers. There is a downside of this and so i would carefully consider requesting jusgement before doing it!!

3. If the bank defends they get a further 14 days to send in their defence papers. You will get a copy of this either from the court or from the banks Sols themselves.

4. You will both then get sent allocation questionairres. These are to decide which track it will be heard on. You will complete this (help is on site) and send this back.

5. The judge will look at the AQ and decide on:

a) small track and send a date for trial

b) allocation hearing to decided which track but as your claim is clearly under the small claims track i cant see this happening!

6. You get the date of the hearing...the bank will refund the money in the days leading up to the hearing, if not before.

 

Although it is vitally important to be prepared, dont be too worried about the court bundle...this will be needed usually 7-14 days before the hearing. You will need 3 sets, 1 for you, 1 for bank sols and 1 for the court.

Thanks Mrsfoot, I think it looks like they have moved me on anyway!

 

So i notice you can give them 14 days or up to 28 before requesting jusgement? you mention a downside to doing after the 14 day request?

 

Just been reading some more thread and Nationwide people tend to say that they say they will defend and then start paying the money back into your account? Is anyone else at this stage?

Ozz you can request judgement but its likely to be challenged by the defence.

Worst case scenario is that it can slow up the process.

If the bank does not respond within the 14 days and you file for judgement,then its a race against time as to whether it gets awarded before the defendants submit.

Its true to say they are getting away with it for more time.

However if they fail to respond to the Acknowledgement (within 14 days )...and THEN- the defence,its harder for them to drag it out further.

I filed for failiure to acknowledge and the bank sent in the reply next day.Instead of withdrawing my application its staying there in case they miss the defence deadline.

At the end of the day they will pay.........working out WHICH day can often be the problem:rolleyes:

They are going to defend the claim!!

 

Oooohh after reading recent threads i was ready to sit and wait out the 28 days allowed for the claim, but i've just had confirmation from Mr Charles Bacon that they intend to defend all of this claim.

 

What's the next step for me? Iunderstand that in certain cases Nationwide say they will defend and then start paying money back into the account. Can anyone help? should i start prearing my Court bundle now and get it sent off?

 

Has anyone had a similar response recently?

It's only their intention to defend... probably to buy time to get through the backlog. Read up on filling in an Allocation Questionnaire (in case your judge is still sending them out) & compiling a court bundle, just in case. My guess is you won't need it.

Cool Kelly thanks, Well i'll sit and see if the AQ comes through in the post and keep checking my balance. Also i think i'll probably start collating my court bundle...gives me plenty of time that way! Lets just see what they do now, can i expect to have my money back within the 28 days since (10th April) when the mcol was accepted?

You know Ozz, a month ago I would have said yes, almost definitely. But looking at the recent threads, it would seem that it's pot luck as to whether you'll be paid before or after judgement day. I really wouldn't like to hazard a guess. But don't worry if you receive a defence. It's almost certainly a bid for extra time. Follow threads that are running slightly ahead of your dates to get an idea of how Nationwide are playing it.
