Re: xxxxxxxxxx - v - HSBC

account no: (your account number)

claim no: xxxxxxxxx, Filing date:xx.xx.xx.

It has come to my attention that as of xx.xx.xx the filing of an allocated questionnaire may not be required in this case.

I am aware that you have a vast number of claims with which you are currently dealing with, and in order to resolve this matter more quickly, I am willing to accept the sum of £xxxx.xx in full and final settlement. Please note that I do not agree to waive my rights in respect of any other actions, nor do I agree to a clause of confidentiality.

I hope to hear from you very soon so that a reasonable conclusion to this claim might be achieved. I am sure that the courts would approve of our settling this matter in a timely manner and without their further intervention.

I have again enclosed a copy of the schedule of charges. This schedule also shows the total of my claim to date, being the original claim amount (£xxxx.xx), the daily interest total to date (£xx.xx) and the court fee (£xxx.xx).

I look forward to hearing from you soon.

With kind regards,

Yours sincerely,

(your name)

Charliedog, JW post is correct if the AQ has been dispensed with, if you have filed AQ, there is a different letter.

Sorry to butt in JW ;)

Celicaman - my months date with MCOL is up on 10th June - not heard anything from anyone yet apart from served and acknowledged by MCOL etc- so just want to show willing with DG that I am serious ...and want my money back - but that if they want to pay me before it goes to court I am willing to negotiate a settlement - not much less but a bit less...so will it be the same nudge letter?

Charliedog

Its too early to be sending DG a nudge letter, you have to wait and see if DG file a defence & you wont know that until after June 10th.

Then you can send a nudge.

Also would be worth updating your thread about your claim, so peeps can see what & how you are getting on. Keeps it all in one place.

  • 2 weeks later...

I've seen no proof that DG are asking for stays, they have no reason to and any judge would want to know why they want one before granting it.

The stays we have been getting are comming from the district judges who are trying to get settlement however stays actualy have the opposite effect by prolonging the period DG have to make an offer, we have had a lot of success in having these stays removed.

Hi sv, can you start your own thread and tell us your story from the start?

Defence is no problem but you need to follow the advice given on here in proceeding. Need to konw what you have done so far.

Hi Freakyleaky, I have started a thread in YB Forum, or at least I think I have, new to all this never done it before, let alone take the bank on. Sent the Letters requesting money back, to no avail. Received letter back from YB saying usual not entitled to money back, quoting T&C's of account blah blah, offered me £200. In relation to the £3k plus I am claiming back I turned that down, and proceeded with MCOL, and I am now at the stage where they have sent me a defence document and requested a list of the charges?? Hope that explains my situation better.
