Hello

 

I have a claim against Barclays Bank Plc for £1365.00 plus interest at £149.92 totalling £1514.92.

 

Claim issued. Defence filed on teh very last possinble day.

 

No allocation questionnaires were sent out by the Court (Yeovil County Court Claim Number 7YE00261) but White DJ merely made some standard directions, to file and serve all docs upon which one intends to rely no later than 14 days prior to the hearing which is on 15 May 2007 at 12:00pm.

 

I'm a Solicitor by the way too :)

It does make it rather less nerve-racking, yes. That said, whilst I've represented others, I've never represented myself before in Court so it is a little different, and to be honest I've learned the law through the media on this one, not being an area with which I am particularly familiar. I do specialise in litigation however and so the claims process itself causes no concern.

 

It would appear that nearly all settle though. Has anyone actually faced Barclays in Court does anyone know?

not to my knowledge, I think if you were claiming £10,000's it would be different but they always settle saying they feel the amount in question is nominal and isnt worth pursuing, what they really mean is their own solicitors are too damn expensive LOL

It's a commercial decision they make and clearly they've taken the view that they need to be seen to play hard ball up until the last minute in order to put people off. Having spoken to others who are doing this against other banks, Barclays do seem to be the least willing to settle early doors. Not sure if this is anyone else's experience?

Yes i totally agree with your statement, well they are prob one of the biggest now arent they?

 

what we need is someone to open a banking business with interests of customers as a priority, ok they need to make a profit but not by taking the p***.

I initially thought the Virgin bank would be like this, with Branson involved but found out its just another outlet of RBOS.

What was the last date there defence was due? I'm just trying to see how much quicker the court dates are coming now they seem to be doing away with the allocation questionare. It would be nice to have my money back before I go on holiday.

23/02/07 Request for payment sent (hand delivered to my local branch)

08/03/07 Standard Letter from Barlclays saying they are looking in to my complaint received

13/03/07 Letter before action sent (hand delivered to my local branch)

27/03/07 Partial offer of £1255 received

29/03/07 MCOL submitted

Just received an offer for £1734.92. Going to fax an acceptance tomorrow. Don't know why they've offered more than I'm claiming! It works out at an extra £100, which is the cost of teh AQ, so I presume they must have assumed I paid it.

I submitted my claim via MCOL, which they said they were going to defend, they had til last Friday to do this which they did at the last minute, I haven't heard anything since tho and haven't received an AQ. Any ideas on what I can expect to happen?

I'm not "saying" anything, just mentioning what happened to me.

 

If your claim is beow 1500 you will not get an AQ, just directions from the Court and expect them to settle approx 2 weeks before hand.

 

If over 1500 you should still get an AQ to complete and return along with £100 Court fee. Therefater directions from the Court and therefafter they should settle approx 2 weeks before
