      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi All

 

going to try and get two satisfied defaults removed. first with style finance/ted baker card and the second 1st credit/barclay card

 

i've downloaded the surlybonds template letter and am gonna send it out to 1st credit in the morning

 

any advice?

just checked my credit file and the 1st credit default has been removed!!!!!!!!

your templelate really helped. I stuck to it exactly and just entered the name of the 1st credit who had the default against me.

 

this could help so many people change there lives by getting rid of settled accounts with defaults

 

i'm sending it off to style financial on mondsy morning

hmmmmmmmm

 

just got a reply from 1st Credit basically telling that they have taken guidance from the OFT and wont be following my request to stop processing my data! He claims that he has attached a copy of the default notice which has no account reference or my name and address on it and isnt really a default notice it just says that if i dont pay by xxx then they will send a formal demand and then issue a default.

 

The thing which confuse's me is i've checked my credit record and the default has been moved but they marked it settled in november 2005 and not in november 2007!!!!!

 

The guy from first credit also claims that barclays will remove the default in 2011 but it was first credit who defaulted me!!!!

 

i'm confused what to do should i write back to them or just leave it be as the default has been removed

 

surly i'd apprciate your input on this one

i wrote asking for the default to be removed

 

checked credit file and default has been removed

 

they wrote back and told me they wouldnt remove the default and my argument to have the default removed was unfounded even though the default has been removed

Great news, did you get the default's removed by using Surly's template letter, doesn't seem to be working for me in relation to Next Directory, am still trying and have asked for a true copy of my default notice but they do not keep them, so they have sent me a reproduced copy with the wrong postcode :mad:

Well done for getting the defaults removed - it must be a real relief :D :D

 

I have a small question though I have 5 defaults on my credit report all dated in 2003 & 2004, all relating to when I was with my ex (grrr;) )

 

These debts were being paid with a payment plan via the CCCS and were fully repaid when I remortgaged (to buy out my ex) in June 2005.

 

My question therefore is - As the accounts were still open when the defaults were registered is this method still relevant to my requesting their removal?

 

I ask because the accompaying letter says "In my case, you are retaining and processing data (whether or not this is a simple renewal process of the default flag, daily or other timed factor) after the cancellation of the contract. As that contract is no longer in situ, then my written permission has also ceased from the date of cancellation."

 

And my defaults were recorded whilst the contract was still in effect. Wasn't it? I don't know :-? :-?

 

Sorry for hijacking your thread but any help really would be very very much appreciated.

Yes i did use surly's letter. Did you send them the S10 notice as well as the letter text? They have 21 working days to comply with the S10 which is what happened with me with style financial. I didnt hear another from them at all the default just disapeared after the timescale was up.

 

what did next say when you sent them the letter's

 

have you though about going to the ICO to enforce your S10 notice

 

Surly is the real exeprt on this have you tried contacting him

from what i understand all the accounts attached to these defaults have been settled?

 

if you have settled the debts then the surly method will apply to you it dosent matter if the accounts were open when the default was applied all that matters is that the accounts have been settled

 

what the letter is stating is as you have settled the accounts they are now closed and when they are closed your written permisson for them to process your data ends

 

make sure you send them the S10 notification with the letter and also make sure you send it recorded. Dont suprised if you dont hear anything from them or they send you a BS letter in reply. But check your credit file a month after sending the S10 and you may find the default has gone!
