    • love the extra £1000 charge for confidentialy there BF   Also OP even if they don't offer OOC it doesn't mean your claim isn't good. I had 3 against EVRi that were heard over the last 3 weeks. They sent me emails asking me to discontinue as I wouldn't win. Went infront of a judge and won all 3.    Just remember the law is on your side. The judges will be aware of this.   Where you can its important to try to point out at the hearing the specific part of the contract they breached. I found this was very helpful and the Judge made reference to it when they gave their judgements and it seemed this was pretty important as once you have identified a specific breach the matter turns straight to liability. From there its a case of pointing out the unlawfullness of their insurance and then that should be it.
    • I know dx and thanks again for yours and others help. I was 99.999% certain last payment was over six years ago if not longer.  👍
    • Paragraph 23 – "standard industry practice" – put this in bold type. They are stupid to rely on this and we might as well carry on emphasising how stupid they are. I wonder why they could even have begun to think some kind of compelling argument – "the other boys do it so I do it as well…" Same with paragraph 26   Paragraph 45 – The Defendants have so far been unable to produce any judgements at any level which disagree with the three judgements…  …court, but I would respectfully request…   Just the few amendments above – and I think it's fine. I think you should stick to the format that you are using. This has been used lots of times and has even been applauded by judges for being meticulous and clear. You aren't a professional. Nobody is expecting professional standards and although it's important that you understand exactly what you are doing – you don't really want to come over to the judge that you have done this kind of thing before. As a litigant in person you get a certain licence/leeway from judges and that is helpful to you – especially if you are facing a professional advocate. The way this is laid out is far clearer than the mess that you will get from EVRi. Quite frankly they undermine their own credibility by trying to say that they should win simply because it is "standard industry practice". It wouldn't at all surprise me if EVRi make you a last moment offer of the entire value of your claim partly to avoid judgement and also partly to avoid the embarrassment of having this kind of rubbish exposed in court. If they do happen to do that, then you should make sure that they pay everything. If they suddenly make you an out-of-court offer and this means that they are worried that they are going to lose and so you must make sure that you get every penny – interest, costs – everything you claimed. Finally, if they do make you an out-of-court offer they will try to sign you up to a confidentiality agreement. The answer to that is absolutely – No. It's not part of the claim and if they want to settle then they settle the claim as it stands and don't try add anything on. If they want confidentiality then that will cost an extra £1000. If they don't like it then they can go do the other thing. Once you have made the amendments suggested above – it should be the final version. court,. I don't think we are going to make any more changes. Your next job good to make sure that you are completely familiar with it all. That you understand the arguments. Have you made a court familiarisation visit?
    • just type no need to keep hitting quote... as has already been said, they use their own criteria. if a person is not stated as linked to you on your file then no cant hurt you. not all creditors use every CRA provider, there are only 3 main credit file providers mind, the rest are just 3rd party data sharers. if you already have revolving credit on your file there is no need to apply for anything just 'because' you need to show you can handle money. if you have bank account(s) and a mortgage which you are servicing (paying) then nothing more can improve your score, despite what these 'scam' sites claiml  its all a CON!!

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I sent off my CCA letter (on 10th February 2007) to Sainsburys bank, and they have not provided the agreement.

 

In the past two weeks they have phoned every day at least twice a day. When I have answered the phone, I would however not give out my personal details (i.e. date of birth, and postcode) and the caller has always got very shirty as obviously they cannot speak to me without me confirming my details

 

I have asked them to put anything in writing, but they are obviously not interested in doing this. Today I told the lady to put it in writing as I was getting sick of the phone calls. I did mention that I had requested a copy of my agreement and that they had not provided this and I only wanted to corresspond in writing. She did tell me that they can phone me up to 4 times a day!!!!

 

Arrgghh they are driving me nuts :rolleyes:

 

I have now made a note of the calls, time etc and briefy what was said.

Thanks Ladybird, I have copied that letter and I will send it off to them next week, recorded delivery. It will be interesting to see if they phone me over the next week.

 

I have had two phone calls from them today and two yesterday ....

 

I also have a savings account with them and due to their actions I will be closing this.

Well they phoned again :) so that was three times so far today. Letter will be sent to them Tuesday, also stating that I wish to close my savings account and I will no longer be shopping in their stores, which I have done now for the past 15 years!!!!

Mrswonder, thanks for the advice, I had taken some money out last week so there is only about £3 left in their now, me and my husband had a standing order go into there each month, I will cancel this now and set up a standing order for premium bonds instead :)

Sainsburys Bank is actually Bank of Scotland. Tesco is RBOS. They just trade under the name so there's no point in changing where you shop. Best to just stay clear of Bank of Scotland.

Where does that leave me.

Im sorry if Im being stupid but I dont understand what you mean. Do you think that they will take all your money? If thats the case then I would suggest you change your bank account. I used to work for Sainsburys Bank when I was a student and worked at BOS so I know that for sure.

 

Most of the big banks are behind the supermarket finance so its best to check things out before you change accounts.

Hi gemspan.

A while ago when my problems first started, I had another account at the TSB.

When i got into difficulty, they wouldnt listen and when i cancelled my Direct debits and paid in smaller amounts, they ended up taking what they wanted out of my accounts anyway.

As you can imagine, this meant I couldnt pay other bills and that started the ball really rolling for the rest of my debts which rapidly spiralled out of control.

 

Since I am now techically in the same banking group, if they do something similar, I am finished completely.

Might just as well give up working and go bankrupt.

Of course I will pay you everything you say I owe with no proof.

I dont think they would be able to do what TSB did as technically they are different parts of the bank but I suppose they could if they wanted to as they are all the same group. That's the problem these days; they are all related in some way.

 

Perhaps you could try opening a building society account!

Well cancelled my standing order into my Sainsburys savings account and I have withdrawn the balance. Harrassment letter typed and will be sent tomorrow (signed for :) ). Thanks for everybodies help :)

Well they received the letter today, got a call 2.34 today from them today but I was at work, received another call today at 6.30pm and the person hung up, also I received a statement today from them with interest and a late payment fee!!!! arrrgghhhh they are getting me VERY angry!

OMG they are doing my head in, I have had four calls from them today!!!!! once putting the phone down.

 

call 2.34 I was at work

call 6.30 pm they put the phone down when I answered

call 8.20 pm told caller I was unhappy about phone being put down on

me and referred them to my letter.

call 8.31 pm told them yet again that I was unhappy about 6.30pm call

and told them not to phone.

 

arrrgghhhhhhhhh!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

Use an ansaphone Tigs or if you do answer, as someone said on here, give them the wrong date of birth, apparently they can't proceed any further with the call 0r say (I've found this always fazes them)what is your name, thank you I have recorded this call at (whatever time) you do realise that this is again the law and I shall be reporting this as a crime to the Police plus passing information on this to Trading Standards or just say hang on a minute and walk away and make a nice cup of tea, put the washing on, do some ironing or jump up and down on your mini-trampoline or punch a punchbag and then return and put the phone down, its their call and they are paying! The message should finally get through to them - I must admit I myself found Sainsburys one of the worst but I think they didn't enjoy talking to me either because I used to tell them they'd look good in court with a woman recovering from breast cancer and also of course that all their penalties were unenforcable etc etc rant rant!!!

I have tried alsorts Miss Muppet, so far I have never given them any of my personal details so they cannot go any further, they even have the cheek to ask why I won't give out my personal details, I told them they could be anybody and I didn't have to, I have even had one caller insist that I go into a Sainsburys Bank, I told him that if I didn't want to that I didn't have to and that he couldn't force me to. Lately I have told them to just take me to court as I really want a judge to hear what they have said on the phone to me and also how many times they have called me, let alone the fact that they haven't supplied a copy of the agreement, she told me that they didn't want to take me to court, I said well I WANT YOU TO!!! that threw her a bit!! lol

 

I think I will now however pick up the phone and keep them waiting for a bit, did that to another one and finally they got the message :-) I just refuse to not answer my phone because of them. Hopefully in the next couple of days my letter will filter through to them

Tigs33 - Remember that Sainsbury's supermarket tagline ? "Try something new today" - do just that. Report the b's to all the statutory authorities going. Think of all the negative publicity for their brand if the matter did go to Court.

Sainsburys Bank is a 50/50 undertaking between HBOS and Sainsbury's plc. They use the same call centres here and possibly overseas. The "collections" call centre (which may or may not be the same as one that deals with their other business) deals with BOS, Halifax, Sainsbury's Bank and AA finance. I am still trying to track down where the o'seas calls we recieved over xmas orginated from.

 

I am just amazed that this, the same call centre which recently made the news with that harassment case, continues unabated with its out-and-out flouting of the law.

I now have BT refuse on my phone and their number is now barred....the hubby was getting rather fed up of them and we decided this was the best course of action.

 

I am now going to deal with their non compliance of my CCA request....watch this space. THIS one I will be taking to court of necessary

I've had an awful few months with these muppets.

 

In one 12 hour period over two days I had 9 calls to my mobile & landline from Sainsbury's Bank.

 

They even said that every call costs £10 which is added to my account.

 

They have now passed it on to JJ Collections who are just as bad.

 

I just put the phone aside now so that they speak into thin air.

Hi can anyone give me some advice please. I had a repayment arrangement with Sainsburys Credit Card brought about by losing my job. I filled out an expenditure form and made an offer of payment each month which they accepted and stopped interest. I paid this religiously on time for 12 months and then I suddenly found interest being added to my account again. After many letters they told me that it was a policy brought in that they would only accept payments for one year then it would go back to normal. I told them that I could not pay this interest and all that has happened is that they keep phoning me sometimes up to 8 times a day. After nearly 6 months of wrangling the interest piling on my card has put it over the agreed limit and they are know charging me £12 overlimit every month also. At my wits end I wrote another letter, and they said that they would hold all calls for 3 months but would not stop interest and would probably then refer my account to a debt collection agency. I am convinced that this is a strategy to make my balance so high I will never repay it. It started at £8,000 and it is know £10,450. Is there anything that I can do.
