      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi Everyone,

 

Just typed out my DPA letter and will be sending tomorrow.

 

I am in a bit of a black hole with my finances and just can't get out because of the charges. I have a six month old boy (Oliver - as you probably guessed!) and what with living on benefits, trying to work and pay for childcare, as well as the usual £50 charge from A&L taking me overdrawn to another charge is really getting tiring. I cannot get out of this spiral!!!

 

Anyhow, just here to get some moral support as it's making me feel as if I'm to blame for all of this and that I won't get anything back, I hope I'm wrong!!:oops:

Hi olivers mummy and welcome, plenty of peeps feel the same and the charges are what have caused the spiral, you will have your day but you must be patient, stick to the tried and tested route and if you arent sure ask before you act, have a look at other threads in the A&L forum and this will help you see what happens and when, keep your thread updated so if you need help peeps can see the history and advise you.

I've had a good look through today which has made me feel a lot better. Sent the DPA letter today registered delivery so that's the ball rolling. I've given them £600 in overdraft charges since last may, that's not including my DD charges so even if I only get my money back for that it's going to be a massive bonus!!

Still feel sort of guilty, feel as if it's my fault that the charges were put on my account anyway, but I can't magic money out of thin air to put into the bank, and half of the charges are for other charges which I didn't have the money for if that makes sense!!! So out of one failed transaction they have made about £100 each time!

Oh well, we shall see what happens now and hopefully I can reclaim some of my money back. Thank you for your encouraging words bigmac! I shall keep you posted!

Hi olivers mummy, it is irrespective of how the account was managed by the holders. You are quite prepaired to pay their costs they have incurred through your breaches of contract but they must reflect this.

It is widely known that they do not provide evidence of this so you are left with no alternative but to pursue the charges until such times they provide their true costs, pigs may fly first.

I like many others on this site have been through difficult financial times through the years and have often thought if their charges had been fair then how many of those difficult times would i have missed, not to mention the strain in puts on marriages as i say they are in the wrong not you.

TREAT THEM AS THEY HAVE TREATED YOU OVER THE YEARS.

dont feel guilty - i had a good relationship with A&L since 1992 - but when i went over overdraft limit by accident i asked for a temporary increase in overdraft while i took money out of my savings to put right.We had a regular salary going into the account and they refused - which resulted in £134.00 in charges in one go -if they had not been unreasonable i would not have started claim.When I went back 6 years there were over £1000 charges.

Hi Olivers mummy, i am nobody but I have just sent my LBA. A&L have just refused to pay £1300 and £310. If I did not have the money in the first place, why should the banks think they are are my financial advisor and take it anyway! I am going to wait the 14 days and then hit them with the court action. They may be bigger than me, but why should they take what is rigghtfully not theirs. I will fight with you. Go for it. What have you got to lose!!!!

Well my bank has charged me again, taken me overdrawn again and will now no doubt slap another charge on me! :-x I've got confirmation that my DPA was delivered and signed for on 11 Apr so is it 40 days from this date I then argue if I haven't received my statements? or if I have my statements early (Pah!) do I wait the full 40 days to move on to the next step?

 

Can't wait to finally be able to treat my son like he deserves instead of treating Alliance bosses :razz:

Yes they have 40 days from you sending the DPA allowing for a couple of days post. The banks apparent disconcern of these charges will be their downfall, keep your chin up as they are only keeping it warm for you with interest olivers mummy.

They took the full 40 days with me - but if they do turn up early you can proceed - but as far as i know the next letters you must stick to the timetable.

Hi i'm just in the proceed of climing with A&L and feeling a little more confident as i put in a claim to FD and got just over £600 back. A&L do seem to be taking the clims as far as they can but in the end we are all winning and until the day they drop the charges to what reflects the cost they dont have a leg to stand on. Like Bigmac says keep at it and dont feel any guilt for claiming the money back owed to you because i dont thing they feel any guilt from taking cash of a mum with a little boy to look after. Think on number one x

I felt the same as you, that in some way I had brought the situation on myself. But keep going as everyone is encouraging you to do, I have just filed the N1, in the end we will get the charges back because everyone else is. I did feel like the statements were taking forever to come but they did in the end (never been so excited to see bank statements!!)

Nothing yet but it's far too early to receive anything!! Getting a bit concerned listening to the news recently with what's going on with the Natwest! I think all of us and all the banks must be sitting holding our breaths at what the outcome is there! I just hope my statements come soon, the sooner this is over and done with the better!!! :)

I opened an account in Barclays in Jan this year, I think from the frying pan into the fire. They took 1 month to send me a debit card, and even now, I cant use it as a cheque card! The on line banking system has gone down on me. I told them I wish I had never opened the account, they were no better than a&l. WHO DO YOU BANK WITH? Dont fold, I am with you, what help you need try yaesu, he's a lot of help!

Don't worry,A&L will pay up,i just got just over £3000 back and it got to the stage where they confirmed that the summons had been served on them..6 days later i got a cheque through the post.......just waiting for them to close my account if they get time to do it due to everyone claiming!!!!

Hi olivers mummy, dont worry about anything other than HOW you are going to spend your money, keep with it and let them worry, they are the ones caught with their hand in your pocket and if they want to go to court to explain why this is fair then there wont be a court room in the land that will be big enough to hold the people that would want to hear such an explanation.

still waiting for my statements!! It feels like forever but their time limit is a week tomorrow so I'm getting set for the next stage! They cashed the cheque agesago as well but they really are waiting until the very last minute!! Best of luck Jansus, at least they cannot say you aven't given them enough notice. well their 40 days is up today and I have still had no responce! I sent the DPA request registered, checked when it was received and it works out that the 40 days is today. What do I do now? Do I have to allow them a few days delivery in case they posted it today? or do I have to start my complaint against them? Lazy buggers! They cashed the cheque ages ago as well! Oh they do make me mad!

HOORAY! They came this morning!!! Talk about leaving it till the last minute!! Their offices must be busy is all I can say!!

Looking back I've seen some Paid item charges for £25. Can I claim these back as well?

Just entering everything on my spreadsheet now ready to send off tomorrow.
