    • Why would you pay for  service you know to be rubbish? Block their email address and report it as spam. Ignore them.
    • Start off by clicking this link https://www.consumeractiongroup.co.uk/forum/183-postal-and-delivery-services/ that will take you to the beginning of the sub- forum where you will have all the topics which have been posted – listed. The first 10 or dozen or so titles referred to threads which are "pinned" and that means that they are fixed and they tend to be information threads and are not threads which have been posted by people asking for help. If you cast your eye down the various titles you will start to understand what the subject content of each thread is. Eventually you will get to a shaded bar which is labelled "other topics". That shows you the beginning of the various request for help that have been made by people including yourself. You will probably find your own thread at the top of those or near the top. The order changes according to the most recent which has been posted. Start using the forum more and you will get to understand the pattern. If you don't visit very much then it will always be a stranger to you

    • The NTK is not compliant because it states you overstayed but does not state what their permitted parking period is. Anyway the permitted parking period cannot vary from the original period when planning permission for that car park was granted, I suspect it was an all day job or certainly longer than 2 hours 45 minutes. It's always worth getting on to the shops you visited socials and declaring how you will never shop there again and drop an email to the CEO of the store you spent most money it. Other than that it's waiting time for a Letter Before Claim, then snotty letter time. Be prepared for a flood of every increasing threatening letters from the PPC and their tame DCA.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I assume you have an HFC current account (now Beneficial Finance)?

 

In answer to your question, I would say yes, yes and yes.

 

The RD cheque charge is for a cheque that has been returned as "Refer to Drawer" - a bounced cheque.

 

The NFS is the Non Sufficient Funds charge - you can get this for a bounced direct debit.

 

The Admin Fee can be for anything - usually an arrears fee.

 

In all cases, they are automated and certainly do not cost HFC £15 each a throw.

 

If these are one off charges, I'd make a formal complaint and use their complaints process to get what you want - they will try to bat off your complaint, but if you keep to your guns and say you're not satisfied and you'll go to the Financial Ombudsman if they don't refund, they'll cave in because:

 

1. It'll cost them £360 if the FOS gets involved

2. It's not worth the aggro of defending the complaint with the FOS.

 

Even if they did defend the case and won, it will not have any bearing on any legal action you may want to take.

Received my MCOL notice of acknowledgement this morning, so my spreadsheet and a polite letter to ms Eaves telling her that im in this for the long haul will be in the post tomorrow

Agreed - go for the full amount.

 

They are offering half because they know some customers will settle early, which is money saved for them. They will try this with everyone and to be fair, they are a business, not a charity afterall. So it's no surprise, but it's hardly about Treating Customers Fairly is it?!

I'm sending a rejection letter in the morning, I sent a letter to DG on friday with my schedule explaining that I am aware of their delay tactics and I'm willing to see it out to the end and should they make me an offer I would expect it to be well in excess of 85% plus my costs.

I hope they understand that I'm not scared of them and they just as well pay up sooner than later, although it will probably be later

Quick question - what's DG?

 

In terms of your offer, you should be asking for and only settling for the full amount - don't settle for 85% :cool:

 

They will use the process to it's limits, so don't be surprised if they drag their feet - but hang on in there!

HFC filed their defence today so another letter of to DG (DG solicitors scooby), this time telling them if they take thi to court I want the lot, the 85% in the last post was for an early settlement only, why drag it out if they know I'm will to talk to the judge.

Any advise on what to do now

They haven't been particularly difficult with me but I haven't gone as far as court. Looking around the forum I beleive they tend to fold at the last minute.

Completed:

Woolwich: Received £30

Intelligent Finance: Received £1100 after two years and approximately 20 letters, 6 pieces of hair and an eyeball.

Barclaycard: Received £90

HFC: Received £170

Hfc filed their defence last week and guess what I received an offer for 50% of the charges, sent a rejection letter that morning. saterday I received another letter for !00% of the charges but no interest and no costs so another rejection letter off to them monday morning
