Was it unilateral or did they offer it and you accepted it on some condition? When did they send you this £50 cheque? Have you banked it? Also, I think that we need to start understanding what you have lost here. Have you lost any money – and if so how much? Send the SAR to your bank as advised above

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

If the needs and deed statement is not signed and dated, that does not mean that you agreed to it:rolleyes: Does it have your name and the account no on it:-x Is their a link to you or could it be anybody's????????

 

Under the misrepresentation act the onus is on them to prove that they did not mis=sell it, not you.

 

Can you post up the letters, statements etc, you can use the free photobucket to upload them to the site, make sure you omit any reference to yourself.

I am subscribing because I am going to claim my PPI from black horse. I bought a car from Trade Sales, which had PPI on it. They did not discuss any medical exclusions with me and I am 99% sure they told me I had to have it.

I also want to claim for a Lloyds loan and credit cards that I noticed last night have PPI on them!

I do understand how frustating it can be to have your questions overlooked, but why are you giving up:eek:. These matters do that time to get it right, and their will be a few huddles to get over, so you must really dedicated. To give up, is what these companies love.

 

Now, did they apply life cover or actual payment protection cover to the loan. This is in respect to your need and demands statement.

 

In my opinion this statement is worthless, could have been typed up yesterday, no date, no signatures:rolleyes: and by anybody, even me:lol:.

 

Do you have the recorded telephone conversation relating to the deal. or did they not record it:rolleyes:.

Looking at the credit agreements again, the level of insurance changed over the five loan agreements... the 1st loan cover level was 'SSS' (whatever that meant), the 2nd loan cover level was Life, Accident, Sickness, Invol Unemploy. The 3rd was Life, Accident, Sickness, Invol Unemploy. The 4th was Life, Accident, Sickness, Invol Unemploy. The 5th and final loan cover was just LIFE.

 

I don't really understand this... because i only had life cover, does that mean the premiums should have been cheaper???

I do not have any recorded conversations.

 

Like you said, anyone could have typed that needs and demands statement! Do you think i should reply to Black Horse again? Or go straight to ombudsman (or court). They stated on their letter that they would consider the matter closed if i do not reply within 8 weeks i think...

They stated on their letter that they would consider the matter closed if i do not reply within 8 weeks i think...

 

I'll wager they would be really pleased to consider the matter closed within 8 weeks but this is yet another ploy to put pressure on.

 

Stick to your guns and ask for clarification of the cover on each of your loan CCAs. This bunch may actually have been changing the cover on your PPI without you knowing about it and the changes would no doubt relate to additional charges!! You should only have agreed to the cover you required and probably when all is said and done you did not require or agree to the cover on these loans without pressure.

HSBC - Settlement, goodwill no admission of liability about 75% of claim.

RBS - Settlement, goodwill no admission of liability about 70% of claim.

2 ongoing claims for bank charges with HSBC with more to come. (Supreme Court ruling could have upset these claims) They did :mad:

PPI Successes

PPI 4 settlements on 9 loans. FOS involvement on 7 added on the 8 % Statutory interest another 30% to both.

2 claims settled in full with LV without FOS involvement.

2 claims settled in full with HSBC without FOS involvement

 

PPI Claims ongoing with:

Cap one Now with the FOS

Barclays. Paid up today 24/04/10 cheque received for over £4,500 and in the bank.

LTSB still have to decide on this as their SAR production was abysmal. Papers data mixed up documents missing etc

 

1 Complaint not upheld by FOS they said it was ICO issue. Complaint upheld by ICO. See this..

alanalana - You're right... I specifically told them i didnt want any cover at all as my wife works for an insurance company where she gets dicounts on our insurance! But for the first loan back in 2000, i was told i had to have some form of PPI to be accepted for the loan, so agreed to have the minimum cover possible. She made it out as though she was helping me by only giving me the minimum... Then after that, whenever i phoned to increase my loan, they just sorted out how much it was to pay the existing loan, then gave me a quote per month on how much the new loan would be. They then sort out the paper work, so all i have to do is go to their office and sign it. The money was then in the bank the next working day. Even if they had asked me if i wanted insurance, i would have probably siad to give me the minimum, because i was under the impression i had to have it.

 

Just a bit unsure what to do next...

Hello Br4,

 

I have just gone through the posts within your thread.

 

I specifically told them i didnt want any cover at all as my wife works for an insurance company where she gets dicounts on our insurance! But for the first loan back in 2000, i was told i had to have some form of PPI to be accepted for the loan, so agreed to have the minimum cover possible.

 

I believe banks can require you to have some form of insurance, to cover the risk to them. The latest banking code of practice statesbanks cannot make their PPI a condition to you getting the loan ( however this is a code of practice and not a legal statute so some banks will still insist on the PPI).

 

The documents posted via photobucket I presume were for the last loan with life cover only? Was this the only agreement sent to your home? as you stated you went to the bank to sign the pre prepared documents and the PPI was not explained to you.

 

Looking at your figures within your posts it seems to me that all your PPI were single premiums added to the full cost of the loan.

 

In light of their blatant refusal to consider your claim for the refund for the misselling of the PPI, I believe you have two options.

 

1. Write a letter of complaint to the Financial Obudsman service.......Financial Ombudsman Service Send them a copy of your letter to the bank claiming refund of PPI and also enclose the banks letter of refusal to consider your claim for misselling.

 

The banks has 8 weeks to respond to your claim for refund before you can complain to the FOS but in the event of an immediate refusal you can complain to the FOS straight away.

 

(The FOS is currently upholding 4 out of 5 claims) ...........issue 62 - mortgage endowment complaints – capping where the policy remains linked to a mortgage They will look at claims going back 6 years. They may also consider that the relationship between the bank and you was unfair. (you were under pressure in financial need and they saw the chance to hit you with 5 loans each one benefiting the advisor (with potential bonus) that added on the PPI. Mention this fact in your letter of complaint to the FOS they may consider it relevant to your complaint.

 

2. Proceed down the Court route you will have to get advice from another source on this as I have no knowledge yet of the claims procedure.

 

If you go down the Court route and the bank defend and you lose you cannot then go to the FOS path but if you go down the route of the FOS first and they do not uphold your complaint you can then revert to action in Court.
