Trying to get my money back from lloyds tsb i have had the statements back and have sent them the second letter with the spreadsheet i have given them 14 days but have recieved a reply today saying "This doesn't apply to your charges as these were for dealing with your request to go over your agreed overdraft limit. They are not default charges because you havent broken your agreement. They are our prices for the service we provide in these situations. I do hope you can see that we make our charging system as fair as possible-and why i cant agree to cancel your charges."

what should i do now ?

Sue them. This is quite standard and another of their ploys to fool you into thinking that they are entitled to charge you.

 

Continue with your claim - this changes nothing. If they are so sure that their charges are not unlawful, then they will not have a problem explaining them in court will they?

 

Although, you know that they will not.

 

Now you may file your claim.

iGroup (GE Money) - AoS Filed late, defence late, amended defence also late despite extra time requested and granted.

Vanquis - Claim issued, no AoS or Defence received

start a thread in the lloyds forum

read a few threads [esp todays!] and you will see that is a std fob-off letter.

keep going ignore it

stick to your timetable

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Hi Eve.

 

They are still penalty charges and all penalty charges are unlawful, therefore reclaimable.

 

If I gave you a bag of toffees but told you they were a bunch of flowers, would you eat them or put them in a vase of water?

You would eat them, because regardless of what I called them, they would still be toffees.

 

Carry on your action, following the route we suggest and you WILL get them back.
