      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Am in the process of taking N&P to court. I have a current account which although overdrawn was within the agreed limit, I also have a deposit account which has monies in.When I asked for bank charges back they wrote to me offered half the charges back and told me they withdraw my banking facilities. My accounts were frozen. Got a letter from one dept asking how they cou7ld help me move my bankind back to them and another letter threatening to take me to court to recover the overdraft. I was going to use the money in my deposit account to pay off the overdraft but I cant pay monies into my current acc or use the monies in the deposit acc. Consequently my account went over the limit due to interest and N&P then informed me that as I had gone over the limit a new interest rate of 29.9% now applies. I object the this. Anyone got any advise as to where I go from here. Can I get the courts to look at this as well when we go to court soon.

I'm new to this site. I have just received a letter from N&P saying that they will be closing my account on the 12th March!!. Again I have an overdraft on this account and they want this repaid which I am not in a position to do so in one go. They are also say that they will give me back 50% of my charge. Which i'm not happy with I want 100% back. What do I do now!!.

Hi guys, having read all the other probs people are having with N&P I have decided that I wont be bullied. I have also discovered that when I had automatic debits and credits go in on the same day, the debits where taken from the account first so that the account would then go overdrawn and they would then hit me with charges, so am going to write a nice letter to mr presland and tell him nicely that i think he is a bully and since the account is in dispute there is not much he can do and then i will write to the ombudsman and lodge a complaint or several.!! So wish me luck and I will keep all of you up to date.

Having stated legal proceedings against N&P have recieved a letter saying they intend to defend the claim, that sholud be interesting!!!!!, in the mean time they regrert that I am unhappy with the service and would like to discuss the matter with me. As far as I am concerned there is no discussion, give me my charges back in full. Have written a letter of complaint to the CEO about the rude and bullying letters and also about the freezing of my account.

So all N&P people have hope and I will kep you up to date

Have just got another letter from N&P offering me an ex-gratia payment of £400, the claim is for £530. So will not be accepting that, will write a letter outlining my claim again and see what happens, dont give up N&P people!

Hooray, i have got my charges back and more!!! the story was i asked for charges back was offered half and closure of my account which was frozen before the closure date so put my claim into the courts, wrote a letter of complaint to CEO of N&P also a letter of complaint to financial ombyudsman. Got a lovely letter from CEO stating they would repay all my charges and some more they have found!!!!, plus a load of interest, so my £404.00 claim has resulted in £1100.00 refund, thats what i call a result. Think they very worried about ombudsman.

Anyway a BIG thankyou to CAG without you this would not have happened and the rub off is that i am now helping friends claim back their charges.

Hooray N&P are to refund my charges and more!!!!!

I have sinced recieved a lovely letter from CEO offering mefull erfund on the charges i am claiming for and also some charges that they found!!!!!! plus a refund of some of my overdraft interest, so a £404.00 claim has resulted in a refund of £1100.00 Now that is what i call a result, a BIG THANKYOU to CAG, without you i wouldnt have done this nor would i be helping friends to do the same.

I am one very happy bunny, today N&P tomorrow the world!!!!!
